1. Trading households must use invoices from money computers
Decree 70/2025/ND-CP stipulates: Business households and individuals with a revenue of VND1 billion/year or more, operating in the field of selling goods or providing services directly to consumers, are required to use electronic invoices generated from cash registers.
The list of areas of application is very wide, including: retail sales of goods, food, accommodation services, beauty, hairdressing, passenger transportation, sports, entertainment, health care, grocery stores, fashion shops, milk tea shops, cafes, restaurants...
2. No need to buy a POS - just need standard software
A common misunderstanding is that you have to buy an expensive PC (POS) to deploy. However, the regulation does not require this.
Businesses only need to use software or an app that starts generating electronic invoices from devices such as phones, tablets or computers. The software must connect and transmit data to tax authorities in real time.
Currently, there are many standard service providers such as: MISA, VNPT, Viettel, CyberBill, EasyInvoice... with flexible costs, free packages or prices from only a few hundred thousand VND/year.
3. Clarifying the time of issuing invoices
Decree 70 also amends the time of issuing invoices in some cases:
For exported goods (including export processing): The seller can choose the time to prepare the invoice, but must not be later than the next working day after the goods are cleared.
For service provision: The time of making the invoice is when the service is completed, or right at the time of collection if collected in advance.
It is not mandatory to make an invoice when only receiving deposits and advances for services such as consulting, design, surveying, auditing, etc.
4. Add subjects that must use electronic invoices
For the first time, Decree 70 expands the scope of electronic invoice users to foreign enterprises that do not have a permanent establishment in Vietnam but have online sales, e-commerce, and digital services for Vietnamese customers.
These businesses can voluntarily register to use electronic invoices in Vietnam, creating transparent transaction conditions and easy tax declaration.
5. More concept of commercial electronic invoices
Commercial electronic invoices are applied to organizations and enterprises exporting goods or providing services abroad. The condition is that enterprises must have a technology system that meets the need to transmit electronic invoice data to tax authorities electronically.
This concept aims to synchronize export data, facilitating businesses, especially in cross-border trade.
6. Removing many inappropriate regulations
Decree 70 abolishes a series of outdated regulations that are no longer suitable for the practical implementation of electronic invoices. Specifically:
Repeat the regulations on procedures for canceling unused paper invoices according to Decree 123/2020/ND-CP.
Abolish the format of tax deduction documents.
Repeat the regulation on making and authorizing the making of receipts.
Abolish the deadline for providing electronic invoice information.
This helps simplify procedures for taxpayers and reduce administrative pressure.
7. Violations may be fined and have revenue determined
In case of not using electronic invoices from cash registers as prescribed, business households will be fined according to Decree 125/2020/ND-CP:
Fine from 4 - 8 million VND if it is mandatory but not issued an electronic invoice when selling goods or providing services.
In addition, tax authorities can conduct inspections and determine revenue if they detect violations or show signs of tax evasion, causing significant damage to businesses.
What are the regulations for business households with revenue under 1 billion VND?
If a business household has a revenue of less than 1 billion VND/year and is not subject to mandatory regulations, it can still voluntarily register to use electronic invoices from cash registers. This helps to make operations more transparent and more convenient when declare taxes, especially if there is a plan to expand business.
Decree 70/2025/ND-CP is a strong step forward in transparency of business operations, combating tax losses and promoting digital transformation in tax management. Business households, especially in the fields of retail, food and beverage, personal services, etc., need to urgently review to comply with regulations from June 1, 2025.
