On May 8, in Hanoi, Deputy Prime Minister Nguyen Chi Dung chaired a meeting to explain and accept opinions on the Draft Decree regulating business registration.
The draft Decree has been developed by the Ministry of Finance, consisting of 8 chapters with 84 articles and 2 appendices, 78 documents for use in business registration.
In which, 18 articles on business registration are abolished; 2 articles on business registration for credit institutions are abolished and transitional regulations for securities companies are abolished.
The draft adds 8 new articles; adds 2 appendices including 78 forms used in business registration (currently regulated in Circular No. 01/2021/TT-BKHDT); amends and supplements most of the remaining articles.
Reporting at the meeting, Deputy Minister of Finance Nguyen Duc Tam said that in the past, there have been many important policies and guidelines on the arrangement of administrative units with a 2-level government organization model.
Thereby, there are many contents that directly affect the regulations in the draft Decree on business registration. Therefore, it is necessary to continue researching, amending and supplementing to meet the requirements and tasks in the new period.
Currently, the Ministry of Finance is submitting to the Government a draft Decree regulating the registration and operation of business households.
However, on May 4, the Politburo issued Resolution No. 68 on private economic development.
To ensure the completion and institutionalization of the contents and instructions of the Politburo in Resolution No. 68, the Ministry of Finance proposed to postpone the deadline for the Decree on business households to continue researching, perfecting, and in accordance with the new policies and regulations.
In order to meet the requirements of "Ending the operation of the district -level administrative applications and the two -level local government organization", the Ministry of Finance proposed the Government to assign this Ministry to preside over and immediately formulate a decree to amend relevant decrees in the order and procedures for shortening to decentralize and decentralize the commune -level People's Committee (or specialized agency of the commune -level People's Committee).
This is to resolve procedures for registering cooperatives, cooperatives, cooperative unions and business households and some other related contents, implemented from July 1, 2025.
At the meeting, Deputy Prime Minister Nguyen Chi Dung agreed with the proposal to postpone the deadline for the Decree on business registration to update new contents on the basis of implementing the procedures according to regulations, ensuring submission before July 1, 2025.
The Deputy Prime Minister noted that it is necessary to review and update new issues immediately in a spirit of urgency. In particular, focusing on how to implement business registration when there is a two-level government, how to assign it to the commune and department.
Also in the spirit of decentralization and delegation of authority, it is necessary to reduce procedures and apply digitalization to the process according to the policy and new regulations in Resolution 68-NQ/TW and Resolution 57-NQ/TW.
"The amendment must be made once and done methodically, urgently, and immediately meet the requirements to remove obstacles in the process of business registration" - the Deputy Prime Minister emphasized.
Regarding the settlement of procedures for registering cooperatives, cooperatives, cooperative unions and business households, the Deputy Prime Minister agreed that the Ministry of Finance should preside over and immediately develop a decree amending related decrees.
