In addition to beating, there are many cases of forced sexual intercourse beyond the want. The regulation to punish this violation is to protect victims of sexual violence, even though they are husband and wife.
However, when applying this regulation to life, it must be consistent with the practices and culture of the community.
The ancients taught " husband and wife close the door and say goodbye to each other", this saying has a meaning in married life, that is, husband and wife listen, correct bad habits and respect each other.
Of course, there is also negativity in the way of "closing doors and saying things to each other" behavior. The wife or husband should keep silent even though they are afraid that outsiders will laugh at their family matters.
However, most Vietnamese families do not want to bring their family matters to the world to discuss, as our ancestors said in the saying "the tiger is bad for who".
So, the couple's room is a private place, it is difficult for anyone to take it out to file a lawsuit.
There may also be cases of reporting the wife or husband for forced sexual intercourse, but the number cannot be large.
In addition, when the husband or wife is suing, one of them is determined to have violated and is fined up to 30 million VND, which is also the money of both of them.
In most Vietnamese families, money and assets belong to the whole family, money of the husband also belongs to the wife and vice versa, together collecting to take care of the children. So, is there anyone who can blame themselves for losing money?
For poor families, if the husband forces his wife to have sex, is accused and punished by his wife, if they do not have money to pay the fine, what is the sanctions?
Not to mention, it is not simple to determine sexual forced behavior. The act of violence by beating and wounding left traces on the body, while sexual forced marriage had no evidence other than emotional statements.
Therefore, the regulation that husband and wife who force their wife to have unwanted sexual intercourse will be fined up to 30 million VND is very civilized, but has a more meaningful direction towards a harmonious family life and mutual respect than for the purpose of punishment.
