Article 28 of Circular No. 73/2024/TT-BCA stipulates the patrol, control and handling of violations of laws on road traffic order and safety by traffic police effective from January 1, 2025 as follows:
In necessary cases, other forces in the people's police (including commune police) are mobilized to coordinate with the traffic police to patrol and control order and road traffic safety:
During the celebrations; political and social events; major cultural and sporting activities of the State and locality.
Peak periods ensure traffic order and safety under the direction of the Ministry of Public Security, the Traffic Police Department, and the Provincial Police Director.
When the situation of violations of order, traffic safety, traffic accidents and traffic jams becomes complicated.
Other cases where road traffic order and safety negatively affect social security, order and safety.
When mobilizing other forces, including the commune police, the following requirements and principles must be ensured:
Comply with the provisions of the Law on People's Public Security, the Law on Road Traffic Order and Safety, this Circular and other relevant legal provisions.
The mobilization of forces must be carried out by Decision and Mobilization Plan, which must clearly state the forces, the number to be mobilized, the time, route, area of mobilization, responsibilities and specific tasks of the Traffic Police and the mobilized forces.
When the mobilization period stated in the Decision or Mobilization Plan expires without a new mobilization document from the competent authority, other forces in the People's Public Security will end their mobilized tasks and switch to performing regular tasks.
Coordination of forces must be based on the functions, tasks and powers of the mobilized forces, decisions of competent authorities and in accordance with the actual tasks.
Handling of administrative violations when participating in coordinating patrols and controlling road traffic order and safety must comply with the provisions of the law on handling administrative violations; the Government's Decree stipulating penalties for administrative violations of road traffic order and safety; deduction of points, restoration of driving license points and related laws.
Regarding the authority to mobilize, the mobilized forces and the conditions of mobilized officers and soldiers:
The Minister of Public Security decided to mobilize other forces in the People's Public Security to coordinate with the Traffic Police to conduct patrols and controls nationwide.
The Director of the Provincial Police Department decides to mobilize other forces in the People's Police under his/her management to coordinate with the Traffic Police to conduct patrols and controls within the scope of two or more district-level areas.
The District Police Chief decides to mobilize other forces in the People's Police under his/her management to coordinate with the Traffic Police to conduct patrols and controls within the locality under his/her responsibility.
Officers and soldiers mobilized to coordinate with the Traffic Police in conducting patrols and controls must be thoroughly informed and have a firm grasp of the provisions of the law on road traffic order and safety, regulations on administrative sanctions for violations of road traffic order and safety, and regulations on road traffic patrols and controls.
