The Ministry of Public Security is sending the Ministry of Justice for review of the draft (third time) Decree on administrative sanctions for violations of traffic order and safety in the field of road traffic; deduction of points, restoration of driving license points.
Clause 4, Article 41 of the draft stipulates the authority to impose administrative sanctions on traffic order and safety in the field of road traffic for commune-level police chiefs.
According to regulations, the commune police chief is allowed to fine a number of typical traffic violations against motorbike drivers as follows:
Carrying people in the car using umbrellas;
Honking from 10:00 p.m. the previous day to 5:00 a.m. the following day in densely populated areas and medical examination and treatment facilities.
Stop or park on the roadway on suburban roads where there is a sidewalk.
Stopping or parking at bus stops, at road intersections, on pedestrian crossings; stopping where there is a “No stopping and parking” sign; parking where there is a “No parking” or “No stopping and parking” sign; failing to comply with regulations on stopping or parking at road intersections at the same level as railways; stopping or parking within the railway traffic safety corridor.
Carrying 2 people in the vehicle, except in cases of transporting sick people to the emergency room, children under 12 years old, escorting people who have violated the law, the elderly or disabled.
Honking and revving the engine continuously in densely populated areas or medical facilities.
Stop, park on the bridge.
Driving in groups that obstruct traffic, except in cases where permission is granted by a competent authority.
A person driving a vehicle or carrying a passenger on the vehicle, holding on to, pulling, pushing another vehicle or object, leading an animal, carrying bulky objects; carrying a person standing on the saddle, on the carrier or sitting on the handlebars; loading goods on the vehicle beyond the prescribed limit; driving a vehicle towing another vehicle or object.
Not wearing a "motorcycle helmet" or wearing a "motorcycle helmet" with the strap not properly fastened when driving on the road.
Carrying a person on a vehicle who is not wearing a "helmet for motorcyclists" or wearing a "helmet for motorcyclists" without properly fastening the strap, except in cases of transporting a sick person to the emergency room, a child under 6 years old, or escorting a person who has violated the law.
Stopping or parking a vehicle in a road tunnel in an incorrect location; not signaling with emergency lights and placing a sign or warning light behind the vehicle to ensure a safe distance when stopping or parking in a road tunnel in case of technical problems or other force majeure that force stopping or parking.
The driver is not allowed to use an umbrella, audio equipment (except hearing aids), handle the handle and use the phone or other electronic devices.
