According to Clause 10, Article 23 of the Law on Organization of Local Government 2025 No. 72/2025/QH15, effective from July 1, 2025, the responsibilities of the Chairman of the Commune-level People's Committee in recruiting civil servants are as follows:
Chairman of the commune-level People's Committee directs and organizes the implementation of the recruitment, use, and management of civil servants and public employees in the area in accordance with the law and decentralization of higher-level state agencies; decisions on appointment, dismissal, transfer, and dismissal of heads and deputy heads of specialized agencies, other administrative organizations, public non-business units under their People's Committees; decisions on temporary suspension of work for Vice Chairman of their People's Committees, heads of specialized agencies, other administrative organizations, public non-business units under their People's Committees.
Regarding the field of education, the National Assembly has passed Resolution 248/2025/QH15 on specific and outstanding mechanisms and policies to implement breakthroughs in education and training development. In Clause 1, Article 2, the mechanism for recruiting, using and managing human resources in the education sector is regulated as follows:

(ii) The Chairman of the Commune-level People's Committee has the authority to transfer, transfer, assign, appoint, dismiss, change job positions for teachers, management officials of educational institutions and staff in public educational institutions under its management authority;
In addition, Article 4 of Circular 01/2026/TT-BGDDT: The authority to recruit teachers in other educational institutions under the national education system is as follows:
- Principals of university preparatory schools, T78 Friendship School, 80 Friendship School, Viet Bac Highland High School have the authority to recruit teachers under their management authority.
- Heads of schools of state agencies and political organizations; political schools of provinces and cities directly under the Central Government; political centers of communes, wards, and special zones directly under provinces and cities directly under the Central Government have the authority to recruit teachers under their management authority.
- The Director of the Department of Education and Training has the authority to recruit teachers in other educational institutions under the management authority of provinces and centrally-run cities.
Thus, the Chairman of the Commune-level People's Committee does not recruit teachers. Instead, the Chairman of the Commune-level People's Committee has the authority to transfer, transfer, assign, appoint, dismiss, and change positions for teachers, educational institution managers, and staff in public educational institutions under its management authority.
