Resolution No. 32/2023/NQ-HDND of the People's Council of Cao Bang province (effective from July 23, 2023) stipulates the financial support policy for cadres, civil servants, public employees, leaders, managers and commune-level cadres working at agencies, organizations, public service units of the Party, State, Vietnam Fatherland Front Committee, socio-political organizations at provincial, district and commune levels in Cao Bang province who retire early or quit their jobs at their will in the period 2023 - 2026.
The commune chairman is one of the beneficiaries of this policy if he/she meets the conditions. According to regulations, the conditions for the commune chairman to enjoy the support policy include:
- Have a voluntary application and meet the conditions for early retirement due to reduced working capacity according to regulations or have a voluntary resignation application approved in writing by the competent management agency.
- Conditions on working time: The commune chairman must have a remaining working period of 12 to 60 months from the time the competent authority decides to retire early or quit the job at retirement age according to the provisions in Appendix I and Appendix II issued with Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age.
Have paid compulsory social insurance for at least 20 years up to the time the competent authority decides to allow early retirement or termination of employment.
In case of eligibility for pension due to reduced working capacity according to the provisions of the Law on Social Insurance, the Commune Chairman is entitled to the following support:
- Support 2 months of salary for each year of early retirement compared to the actual retirement age prescribed in the 2019 Labor Code and Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age;
- Additional support of 2 months salary for the first 20 years of work with social insurance contributions; from the twenty-first year onwards, for each year of work, support of 1/2 month salary will be provided.
In addition, the difference in pension that is reduced by a percentage due to early retirement is also supported.
The calculation of supported monthly salary is as follows:
Monthly salary is calculated including: Salary according to grade, level or professional title or according to salary table; position allowances, seniority allowances exceeding the framework, seniority allowances (if any) and reserved difference (if any) according to regulations of law.
Monthly salary is calculated as the average monthly salary of the last 5 years (60 months) before early retirement or termination of employment.
