Reader Ngo Giang asked: "I am a Vietnamese citizen married to a Korean, but still hold Vietnamese nationality. I came to Korea on an F6 visa and still use a 9-digit ID card. Can I re-issue a citizen ID card in Vietnam?"
Responding to this content on the Electronic Information Portal, the Ministry of Public Security said: According to the provisions of Clause 1, Article 19 of the 2023 Law on Identification (Law No. 26/2023/QH15), "The person granted an identification card is a Vietnamese citizen".
Thus, the subjects granted ID cards according to the provisions of the 2023 ID Law are only Vietnamese citizens; there is no age requirement and no requirement to have a permanent residence in Vietnam.
In your case, Ngo Giang is required to be issued an ID card. However, according to Point a, Clause 1, Article 24 of the Law on ID Cards, regulations on the order and procedures for issuing ID cards to people aged 14 and over:
“The recipient checks and compares the information of the person needing an ID card from the National Population Database, the National Database, and the Specialized Database to accurately identify the person needing an ID card;
In case there is no information of the person needing an ID card in the National Population Database, it is necessary to carry out procedures to update and adjust information in the National Population Database according to the provisions in Clauses 1, 2 and 3, Article 10 of the Law on Identification.
Therefore, to ensure the conditions for being granted an ID card, your information must be collected and updated in the National Population Database".
