YouMe Law Firm LLC said: Pursuant to Article 5 of Decree 135/2020/ND-CP, retirement at an age lower than the retirement age under normal working conditions is regulated as follows:
Retirement at an age lower than the retirement age under normal working conditions of employees according to Clause 3, Article 169 of the 2019 Labor Code is stipulated as follows:
1- Employees in the following cases may retire at a lower age but not more than 05 years older than the retirement age prescribed in Article 4 of Decree 135/2020/ND-CP at the time of retirement, except where otherwise provided by law:
- Employees who have worked for 15 years or more in arduous, toxic, dangerous or especially arduous, toxic, dangerous jobs on the list issued by the Ministry of Labor, War Invalids and Social Affairs.
- Employees who have worked for 15 years or more in areas with particularly difficult socio-economic conditions, including working time in areas with regional allowance coefficient of 0.7 or higher before January 1, 2021.
The Minister of Labor, War Invalids and Social Affairs promulgates a list of areas with particularly difficult socio-economic conditions.
- Workers with reduced working capacity of 61% or more.
- Employees have a total working time in the profession or job specified in Point a and working time in the area specified in Point b, Clause 1, Article 5, Decree 135/2020/ND-CP of 15 years or more.
2) The lowest retirement age of employees specified in (1) is implemented according to the table below:

The comparison of the employee's month and year of birth corresponds to the retirement age specified in (2) according to Appendix II issued with Decree 135/2020/ND-CP.
