Vietnam Social Security answers readers about the procedures for retirement benefits.

A reader asked: I was born in August 1968, have a household registration in Hanoi and have been living and working in Ho Chi Minh City since 2012. I have paid social insurance for 32 years. So what are the procedures for retirement benefits? When is the time to receive pension?

Vietnam Social Security said: Regarding the application for pension benefits:

According to Clause 1, Article 108 of the Law on Social Insurance 2014, pension applications for employees participating in compulsory social insurance include: Social insurance book; Decision to retire or document terminating labor contract to enjoy pension;

Minutes of appraisal of the level of reduced working capacity of the Medical Appraisal Council for retirees due to reduced working capacity or certificates of HIV/AIDS infection due to occupational accidents for employees infected with HIV/AIDS due to occupational accidents.

Regarding the time of pension:

The settlement of retirement benefits for employees who are paying compulsory social insurance shall be carried out by employers when the employee is eligible for pension according to the provisions of law, the social insurance agency shall base on the documents prepared by the employer and the provisions of Clause 1, Article 59 of the Law on Social Insurance 2014 on the time of pension payment to resolve, accordingly the time of pension payment for employees is the time stated in the retirement decision issued by the employer when the employee is eligible for pension.
