News from Thanh Hoa Tax Department on November 14, the Department's Inspectorate concluded that SPT Architecture Joint Stock Company incorrectly declared deductible input value-added tax (VAT) of VND 120,299,675, resulting in a shortfall of VAT payable of VND 78,940,305, reducing the amount of VAT deductible for the next period by VND 41,359,370.
The above behavior violated Clause 1, Article 16 of Decree 125/2020/ND-CP dated October 19, 2020 of the Government regulating administrative sanctions for violations of tax and invoices.
The company also incorrectly declared income subject to corporate income tax (CIT), resulting in a shortfall of CIT payable of VND 284,987,388.
The above behavior of the Company violated Clause 1, Article 16 of Decree 125/2020/ND-CP dated October 19, 2020 of the Government regulating administrative sanctions for violations of tax and invoices.
Regarding invoice management, the Company issued 6 invoices that did not fully include the required information on the invoice and applied an aggravating circumstance (repeated administrative violations), with a fine of VND 39,000,000. The above behavior of the Company violated Clause 4, Article 24 of Decree No. 125/2020/ND-CP dated October 19, 2020 of the Government.
From the above violations, Thanh Hoa Tax Department requested SPT Architecture Joint Stock Company to immediately pay the amount of 499,998,855 VND, including the amount of tax arrears, administrative fines, and late payment fees mentioned above according to the handling decision of Thanh Hoa Provincial Tax Department.
Discussing this issue, Ms. Vu Thi Uyen - Chairwoman of the Board of Directors and General Director of SPT Architecture Joint Stock Company confirmed the above incident and said that this incident happened due to professional errors of the Company's employees.
SPT Architecture Joint Stock Company (address in Dong Hai ward, Thanh Hoa city, Thanh Hoa province). However, the company has just moved its headquarters to BT 20 MBQH 1858, Quang Thang ward, Thanh Hoa city.
SPT Architecture Joint Stock Company is currently chaired by Ms. Vu Thi Uyen (born in 1984) as Chairwoman of the Board of Directors, General Director and legal representative of the Company.
Changed in July 2021, the Company increased its charter capital from VND 80 billion to VND 250 billion. However, by December 2022, the enterprise reduced its charter capital from VND 250 billion to VND 15 billion. According to the latest data from the Thanh Hoa Tax Department, SPT Architecture Joint Stock Company currently has a charter capital of VND 25 billion.
