On July 3, the Supreme Court No. 1 (Chief Justice Yong Ju Ma) held a trial to sentence actor Yoo Ah In, who was prosecuted for violating the Law on Drug Control (Drug Use).
The court upheld the previous trial's verdict of two years in prison with a suspended sentence and a fine of 2 million won.
Yoo Ah In was brought to trial for 181 times using banned substances (such as Propofol, Midazolam, Ketamine and Remimazolam) from September 2020 to March 2022; illegally purchasing more than 1,100 sleeping pills under someone else's name 44 times, from May 2021 to August 2022. In addition, the actor was accused of smoking marijuana in the US and inciting others to participate.
In the first trial held last September, Yoo Ah In was sentenced to 1 year in prison, fined 2 million won and had to complete 80 hours of drug rehabilitation education, and pay an additional fine of 1.54 million won.
The court found Yoo Ah In guilty of smoking marijuana, frequently using medical addiction drugs and frequently buying drugs under the name of others, but he was not guilty of inciting others to smoke marijuana and destroying evidence.
Both Yoo Ah In and the prosecution appealed the first-instance ruling.
In the second trial held in February this year, the verdict on whether a crime or not is still the same as the first trial, but Yoo Ah In's sentence was reduced to 2 years of probation (suspended) and a fine of 2 million won. The actor was also released after 5 months of detention.
Regarding the reason for Yoo Ah In's sentence reduction, the court stated: "Yoo Ah In suffered from sleep disturbances and depression for a long time. The use of drugs containing banned substances seems to be for the purpose of treating sleep.
Currently, Yoo Ah In does not show any signs of dependence on drugs. He pledged not to re-offend and was held for five months to reflect on his actions.
He has also not been previously punished for similar crimes. The original verdict was too harsh and unfair.
