Ms. T.T. A (Dong Nai) has a university degree and was recruited and ranked as Primary School Teacher Grade IV (V.07. 03. 09) from January 1, 2018, salary coefficient 1.86. On July 1, 2020, she increased her salary periodically to level 2/12, coefficient 2.06; on April 1, 2022, she was promoted 3 months ahead of schedule due to outstanding achievements to level 3/12, coefficient 2.26; on April 1, 2024, she was promoted periodically to level 4/12, coefficient 2.46.
In May 2024, Ms. A was transferred to Primary School Teacher rank III (V.07. 03. 29), ranked salary level 1/9 (2.34), starting to enjoy from January 1, 2024.
Ms. A has a certificate of professional title as a primary school teacher in December 2023. Ms. A asked, is her salary coefficient when transferring to a new rank being reduced in accordance with the spirit of Circular No. 02/2021/TT-BGDDT and 08/2023/TT-BGDDT of the Minister of Education and Training?
According to Circular No. 02/2021/TT-BGDĐT, is there a requirement for the professional title Primary School Teacher rank III when transferring from rank IV (old) to rank III (new)?
According to Ms. A's investigation, Circular No. 02/2021/TT-BGDĐT does not require primary school teachers of rank IV when transitioning to rank III (new) to have a professional title certificate for primary school teachers of rank III (Clause 7, Article 10, Chapter IV of Circular No. 02/2021/TT-BGDĐT), but the locality where Ms. A works requires a professional title and because Ms. A did not have a professional title at that time, Ms. A was classified as not eligible for promotion according to Circular No. 02/2021/TT-BGDĐT.
Ms. A asked, in her case, when transitioning from the old professional title (V.07. 03. 09) to the new professional title (V.07. 03. 29), what will be the coefficient and when will the next promotion be?
Regarding this issue, the Ministry of Education and Training affirmed that the transfer from the professional title Primary School Teacher rank IV (code V.07. 03. 09) to the professional title Primary School Teacher rank III (code V.07. 03. 29), the appointment is carried out according to the provisions of Circular No. 08/2023/TT-BGDĐT of the Minister of Education and Training for teachers who have been appointed according to previous regulations and meet the requirements for training qualifications.
The case of being appointed from the old rank IV to the new rank III according to the transitional regulations of Circular No. 08/2023/TT-BGDĐT is not a promotion from a professional title. Therefore, teachers do not have to meet the requirements for training certificates according to the professional title standards of the assigned rank when carrying out the rank transfer according to this regulation.
Salary ranking when transferring from the professional title Primary school teacher rank IV to Primary school teacher rank III is implemented according to the provisions of Circular No. 02/2007/TT-BNV and Decree No. 204/2004/ND-CP. Accordingly, salary ranking must ensure that the new salary coefficient is not lower than the current salary coefficient.
Therefore, if after being appointed to the professional title of primary school teacher rank III, the salary coefficient is lower than the current salary coefficient before transfer, then that salary ranking is not in accordance with regulations. This case needs to be considered for ranking into a salary grade with a coefficient equal to or closest to the current salary coefficient and implement the time of subsequent salary promotion according to current regulations.
