Ms. H.H. Y said that currently, point b, clause 6, Article 99 of the Law on Education stipulates: "6. The mechanism for collecting and managing tuition fees and service fees in educational activities is specifically regulated as follows:
b) The Provincial People's Council decides on the tuition fee framework or specific tuition fees, service fees to serve and support the school's educational activities for public educational institutions according to the state management authority on education based on the proposal of the Provincial People's Committee".

However, currently Decree No. 66/2026/ND-CP amends and supplements the provisions at point b, clause 3, Article 4 of Decree No. 238/2025/ND-CP dated September 3, 2025 stipulating tuition fees policies, tuition fee exemption, reduction, support, learning cost support and service prices in the field of education and training as follows:
The People's Committees of provinces and cities submit to the People's Councils at the same level to decide on specific tuition fees as a basis for implementing tuition fee exemption for preschool children, general education students, and people studying general education programs in public educational institutions; decide on tuition fee support levels for preschool children, general education students, and people studying general education programs in private and semi-public educational institutions according to their management authority for application in localities.
The People's Committees of provinces and cities decide on the detailed list of revenues, collection levels and revenue and expenditure management mechanisms for enrollment services, services serving and supporting education and training activities in public educational institutions under their management authority for application in localities".
So, is the authority to apply to this content applied according to the provisions of the Education Law or Decree No. 66/2026/ND-CP?" - Ms. Y asked.
Regarding Ms. Y's question, the Ministry of Education and Training said that in 2025, the National Assembly issued the Law amending and supplementing a number of articles of the Law on Education (Law No. 123/2025/QH15 dated December 10, 2025). Point b, Clause 6, Article 99 of the 2019 Law on Education was amended in Clause 24, Article 1 of the Law amending and supplementing a number of articles of the Law on Education, which stipulates:
“4. The mechanism for collecting and managing tuition fees, and fees for services serving and supporting educational activities are specified as follows:
a) The Government stipulates the mechanism for managing tuition fees, services serving and supporting educational activities, and service prices in the field of education for educational institutions in the national education system;
b) The Provincial People's Council decides the specific tuition fee level as a basis for implementing tuition fee exemption for preschool children, general education students, and people studying general education programs in public educational institutions; decides the level of tuition fee support for preschool children, general education students, and people studying general education programs in private and semi-public educational institutions at the request of the Provincial People's Committee;
c) Provincial People's Committees regulate the mechanism for collecting and using the collection level of enrollment services at all levels of education, decide on the list and collection level of services serving and supporting educational activities managed by localities in accordance with the provisions of Clause 2 of this Article; ...”.
Thus, the contents on authority stipulated in Decree No. 66/2026/ND-CP are appropriate and consistent with the provisions of Clause 24, Article 1 of the Law amending and supplementing a number of articles of the Law on Education (Law No. 123/2025/QH15 dated December 10, 2025).
