The Ministry of Education and Training (MOET) has just completed the draft Decree stipulating the functions, tasks and powers of national universities (replacing Decree No. 201/2025/ND-CP dated July 11, 2025 of the Government) and posted it on the Ministry's Electronic Information Portal to gather broad opinions from relevant agencies, organizations, and individuals according to regulations.
The draft Decree is built on the basis of the Law on Higher Education No. 125/2025/QH15 and the Education Law No. 43/2019/QH14, which were amended and supplemented in 2025, to ensure the unity and synchronization of the legal system in the context of many changes in the legal regulations on higher education. The promulgation of the Decree aims to improve regulations on the functions, tasks and powers of national universities, meeting the requirements of innovation in university organization and governance, while ensuring transparency, clarity and feasibility in implementation.
The draft stipulates the functions, tasks and powers of national universities; applicable to national universities and agencies, organizations, and individuals related to the management and operation of national universities. The draft includes 05 articles, stipulating the contents on the scope of regulation, subjects of application; position, function; tasks, powers; effectiveness and responsibility for implementation.
According to the draft, national universities are public higher education institutions managed by the Ministry of Education and Training, with legal status, private accounts and using seals with the National Emblem; performing the function of training at higher education levels, scientific research and technology transfer in multi-disciplinary and multi-field high quality, in which some training fields reach advanced levels, approaching regional and international levels.
The draft also stipulates the main tasks and powers of national universities in the fields of organizational structure and personnel; training; science, technology and innovation; financial management, assets and other contents according to the provisions of law.
A noteworthy content of the draft is the adjustment of regulations on organizational structure and personnel work. Accordingly, the draft has omitted contents related to "chairman of the national university council" compared to regulations in Decree No. 201/2025/ND-CP. This adjustment stems from the new regulations of the Law on Higher Education, according to which the organizational structure of public higher education institutions no longer has a university council or school council.
Another noteworthy content is that the draft clarifies the authority in personnel work in the direction of: National University reports to the Ministry of Education and Training to submit to the Prime Minister for decision on the position of director; The Ministry of Education and Training considers and decides on the position of deputy director according to the Party's regulations and relevant laws.
Previously, according to the provisions of Decree No. 201/2025/ND-CP, the consideration and decision to appoint and dismiss the position of deputy director of a national university is under the authority of the Prime Minister.
