Mr. H.Đ (Da Nang) reflected that, according to Circular No. 05/2024/TT-BGDĐT dated March 19, 2024 of the Minister of Education and Training stipulating the standards and conditions for considering promotion to professional titles of teaching staff in public higher education institutions and pedagogical colleges, teaching staff are eligible to register for promotion consideration when they meet the standards and conditions; including the content: "Public higher education institutions have needs, have job positions that are still lacking" corresponding to the professional title registered for promotion consideration.
The promotion consideration process is implemented according to Decision No. 1280/QD-BGDDT dated April 17, 2024 of the Ministry of Education and Training.

Accordingly, higher education institutions with the authority to consider promotion must develop a Project to organize the consideration of professional title promotion, which determines: The number and structure of officials according to the existing professional titles of public non-business units; The number of officials that are still lacking according to the requirements of the job position; proposing corresponding professional title promotion targets.
However, in Official Dispatch No. 64/BNV-CCVC dated January 5, 2024 of the Ministry of Home Affairs on determining the rank structure of civil servants and the rank structure of professional titles of public employees, there are regulations: "For public non-business units that self-ensure regular expenditures and investment expenditures (group 1 autonomous units) and public non-business units that self-ensure regular expenditures (group 2 autonomous units), the professional title structure of the unit does not include management public employees".
Mr. Dat asked, for civil servants who are holding leadership and management positions (such as Rector, Vice Rector, Head of Faculty, Deputy Head of Faculty, Head of Department, Deputy Head of Department... ) but are still holding professional titles of lecturers, when considering promotion to professional titles, is the determination of the "professional title structure" of the unit considered for these civil servants or not?
At the same time, the determination of "missing targets" based on job positions in the Project on promotion consideration is carried out according to what specific principles, bases, and criteria to ensure uniformity, avoid different understandings and applications between public non-business units?
Regarding this issue on the Government Electronic Information Portal, the Ministry of Education and Training said that currently, the guidance on leadership and management positions and professional title positions in education and training in higher education institutions and public pedagogical colleges is regulated in Circular No. 04/2024/TT-BGDDT dated March 29, 2024 of the Minister of Education and Training.
The process of considering professional title promotion is carried out according to Decision No. 1280/QD-BGDDT dated April 17, 2024 of the Ministry of Education and Training on announcing internal administrative procedures in the field of regimes and policies for teachers under the management scope of the Ministry of Education and Training.
Regulations on the structure of public employees according to professional titles in higher education institutions and public pedagogical colleges have not been promulgated.
Therefore, it is proposed that higher education institutions report to competent management authorities to decide on the approval of the Job Position Project of higher education institutions based on the needs of using public employees (including public employees holding management official positions), determining the structure of public employees according to titles in higher education institutions to ensure compliance with the actual situation of higher education institutions.
