The Ministry of Education and Training (MOET) has issued Circular No. 08/2023/TT-BGDDT (effective from May 30, 2023) amending regulations on salary classification for preschool teachers, primary school teachers, and public secondary school teachers, including regulations on appointment from the old to the new grade corresponding to teachers.
However, in the past, many teachers have questioned and sent questions to the Ministry of Education and Training about the time of holding the rank, promoting... Among them, a teacher in Tuyen Quang asked the following question:
"I graduated from a pedagogical college in 1999. In 2001, I was called up to the payroll. In 2022, I have a university degree, transferred to the new Grade III.
When Circular No. 08/2023/TT-BGDDT was issued, I submitted an application for promotion from Grade III to Grade II, but the levels did not accept the application because they thought I had just received a university degree, less than 9 years to hold the rank. Is it correct for my case to apply this? ".
Regarding this issue, on February 27, the Ministry of Education and Training responded as follows:
The condition for holding the rank to be registered for promotion to the professional title of Grade II Secondary School Teacher is: Having held the professional title of Grade III Secondary School Teacher (code V.07.04.32) or equivalent to 9 (ten) years or more (excluding probationary period) up to the deadline for submitting an application for registration or being considered for promotion (Clause 4, Article 3 of Circular No. 08/2023/TT-BGDDT and Clause 5, Article 7 of Circular No. 13/2024/TT-BGDDT).
In addition, according to the provisions of Clause 3, Article 13 of Circular No. 13/2024/TT-BGDDT, the period determined to be equivalent to the period of holding the professional title of Grade III Secondary School Teacher (code V.07.07.002) includes:
"a) Time holding the professional title of Grade III Secondary School Teacher (code V.07.07.32);
b) Time for teachers to hold the professional title of Grade III Secondary School Teacher (code V.07.07.12);
c) Time for teachers to hold the rank of Senior Secondary School Teacher (code 15a.202);
d) Other times determined by competent authorities equivalent to the ranks and ranks specified in Point a, Point b, Point c of this Clause when teachers are transferred to the professional title of junior high school teacher;
d) Working time in accordance with the provisions of law, with compulsory social insurance payment that meets the Government's regulations at Point d, Clause 1, Article 32 of Decree No. 115/2020/ND-CP has been amended and supplemented in Clause 16, Article 1 of Decree No. 85/2023/ND-CP".
