Mr. C.H. H's wife (Tay Ninh) is currently an elementary school accountant, has worked at the school for 16 years (staff), the current salary coefficient is 3.99. His wife has completed a second university degree in elementary education and has full professional title certificates of Primary Teacher, grade II, foreign languages, informatics; fully meets the conditions to become a primary school teacher.
Currently, Mr. H's wife's elementary school is short of teachers. Mr. H asked, is it possible for his wife to switch to being a primary school teacher? If switching, will they have to re-examine from the beginning or be transferred from accounting to primary school teacher? If switching to being a teacher, will the current salary coefficient of 3.99 be preserved? What are the transfer documents needed and submitted to the Department of Home Affairs or the Department of Education and Training?
Regarding this issue, the Ministry of Education and Training answers as follows:
Civil servants currently in accounting positions who need to transfer to become teachers in public educational institutions can register to directly participate in civil servant recruitment exams of educational institutions or change their job positions according to the provisions of the law on civil servants.
According to the provisions of Article 32 of the Law on Public Employees No. 58/2010/QH12 amended and supplemented by Law No. 52/2019/QH14: "When a public non-business unit has a need, a public employee can be transferred to a new job position if they meet the professional and nghiệp vụ standards of that job position...". In case the school has a need, if the public employee fully meets the professional and nghiệp vụ standards and wishes to transfer to a primary school teacher, it is necessary to have the consent of competent authorities, organize the implementation of job position transfer and change of professional title according to the provisions of law.
The Ministry of Education and Training said that accounting and primary school teachers are two job positions belonging to two different professional fields. Changing job positions from accounting to teacher must go through inspection and evaluation of standards, conditions, qualifications, professional capacity, nghiệp vụ, including pedagogical nghiệp vụ. At the same time, after implementing job position transfer, management and use agencies must create conditions for transferred people to participate in appropriate training and fostering courses to improve professional capacity.
Salary ranking in case civil servants change professional titles is implemented according to the provisions of Circular No. 02/2007/TT-BNV of the Ministry of Home Affairs.
Accordingly, salary ranking when transferring ranks in the same type of civil servant and public employee in cases of being appointed to a new rank in the same rank group as the old rank (old and new ranks have the same salary grade coefficient), then rank equal to the salary grade and the percentage of seniority allowance exceeding the frame (if any) being enjoyed in the old rank (including calculating the time for considering salary promotion next time or considering enjoying seniority allowance exceeding the frame if available in the old rank) to the new rank.
The Ministry of Education and Training also requested Mr. C.H. H's wife to contact and report to the school where she works for consideration and reporting to competent authorities to implement the change of job position and professional title of civil servant according to the provisions of law.
