The Ministry of Education and Training (MOET) is drafting a Decree amending and supplementing a number of articles of Decree No. 04/2021/ND-CP regulating administrative sanctions in the field of education, which has been amended and supplemented by a number of articles under Decree No. 127/2021/ND-CP of the Government.
According to the third draft, for the first time the Ministry of Education and Training mentioned sanctions for extra teaching activities.
Accordingly, individuals and organizations that teach extra classes to primary school students in violation of regulations; teach extra classes with fees for regular students or teach extra classes outside of school but do not report to the principal; participate in managing and operating extra classes and extra classes outside of school in violation of regulations, will be fined 2-5 million VND.
The school will be fined 5-10 million VND if it organizes extra classes for students not subject to regulations; when there is no registration from learners for each subject; does not develop an extra teaching plan for each subject, class block and does not make it public...
The Ministry of Education and Training expects the highest fine to be 10-20 million VND and suspends educational activities for 6-12 months for establishments that do not register for extra teaching business. In case of not publicizing or not fully publicizing or not really publicizing the content of extra teaching and learning, the fine is the same.
In addition, the Draft also stipulates remedial measures: Returning the collected amount and covering all costs for the organization of the return for the violation.
Details of the penalty for violations of extra teaching and learning are expected by the Ministry of Education and Training as follows:
Circular 29 on management of extra teaching and learning of the Ministry of Education and Training takes effect from February 14.
Accordingly, primary school students are prohibited from teaching and learning additional cultural subjects.
Schools are only allowed to teach extra classes and do not charge fees for 3 groups: Students with results in subjects at the end of the semester at the level they have not achieved; students selected by the school to train excellent students and final year students voluntarily register to review for entrance exams and graduation exams according to the school's education plan.
Students who want to study more at school need to apply, each class cannot exceed 45 students. For each subject, the school is not allowed to teach more than two extra periods a week. The organization's budget is from the state budget and other legal sources.
