According to Ms. Tran Thu Huong (Ninh Binh), Circular 29/2024/TT-BGDDT requires additional teachers to have appropriate professional competence.
Ms. Huong asked the Ministry of Education and Training (MOET): "How are professional capacity standards evaluated? If they do not study pedagogical subjects but have a college or university degree, can they teach extra classes? Can I teach at the invitation of parents, or can I go to students' homes to study? ".
Responding to Ms. Huong's question, the Ministry of Education and Training responded on the Government Electronic Information Portal as follows:
Extra teaching and learning activities according to the provisions of the Investment Law are not conditional business activities, therefore, extra teachers outside of school as prescribed in Clause 2, Article 6 of Circular No. 29/2024/TT-BGDDT dated December 30, 2024 of the Minister of Education and Training regulating extra teaching and learning do not have to meet any professional capacity standards according to the provisions of law but must ensure that they have appropriate professional qualifications to be able to meet the minimum professional requirements of the subject for extra teaching, ensuring educational quality.
In fact, this is not the first time the Ministry of Education and Training has received questions related to the issue of extra teaching and learning. Most recently, at the question-and-answer session, the 9th session of the 15th National Assembly, there were many opinions raised by National Assembly deputies on this issue.

For example, according to delegate Dang Bich Ngoc (Hoa Binh), Circular 29 stipulates that teachers who are teaching are not allowed to teach their students, which is not appropriate. Because many teachers are very good at teaching students and parents want their children to study these teachers extra. There are families who want to let their children take extra classes and have to circumvent the law and change the rules, this is something voters are interested in. Therefore, it is important to control the study program and exam.
Responding to questions raised by delegates, Minister Nguyen Kim Son repeatedly emphasized his view that Circular 29 does not prohibit extra classes, but only prohibits a few things. Students who want to find a good teacher, want to teach and want to learn, according to regulations, are not prohibited.
However, according to the minister, the Circular only notes that teachers are not allowed to teach their own students to ensure competitiveness, because students have studied in class, not taking each other to the center to study anymore.
He also said that it is necessary to limit extra teaching, inside and outside of school, so that students have time to self-study, read documents, learn related skills, and equip themselves with other necessary things.
"Depending on the needs, we must also ensure "keeping children's childhood". We have considered ensuring that the main teaching time of the course meets the requirements. Not all students volunteer to meet the needs of the school environment" - the minister affirmed.
