Mr. Pham Van Duong was a contract lecturer at Phu Tho Medical College from January 2008 to April 30, 2011, a contract lecturer at Ninh Binh Medical College from May 1, 2011, to January 2019 passed the civil service exam and has worked until now.

Mr. Duong said that he has paid social insurance in full during his entire working period. However, he was not counted for accumulating the previous working time but was only counted as a senior since January 2019.

The Ministry of Education and Training responds to this issue as follows:
The seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, the time for calculating seniority allowances for teachers includes teaching and education time with compulsory social insurance contributions in public educational institutions (or non-public institutions if employees are subject to compulsory social insurance according to the provisions of the law on labor and education).
For teachers with a teaching and education period of 5 years (60 months) and paid compulsory social insurance, seniority allowances will be calculated at 5% of the current salary, plus leadership position allowances and seniority allowances exceeding the framework (if any). From the 6th year onwards, each year will be charged an additional 1%.
Mr. Pham Van Duong was recruited as a civil servant in the education sector in January 2019, having previously taught under contracts at public educational institutions and paid compulsory social insurance.
Based on current regulations, the teaching time for contracts with compulsory social insurance contributions in Phu Tho Medical College and Ninh Binh Medical College is accumulated to receive seniority allowances.
