Ms. V.T. H works under contract in the position of equipment and testing at a secondary school with a professional degree in school equipment and testing.
Ms. H said that she had paid compulsory social insurance in the position of equipment and testing staff at the secondary school for 7 years and 5 months (January 2009 - end of May 2016), and the insurance section stated in the explanatory section "Experimental Assistant".

In June 2025, she was appointed to the position of elementary school equipment staff also with a professional degree in school equipment and testing. She was appointed to the professional title of Technician rank IV, code V.05.02.08, ranked salary grade 1 (internship 6 months) and in the insurance explanation section it is written "Technicalian", my professional title and code are the same as equipment and testing staff at the secondary school level.
Ms. H asked, is the job position "equipment, experimentation" at the secondary school and the job position "equipment" at her elementary school suitable for each other? Is she entitled to salary according to the year of insurance contribution?
The Ministry of Education and Training answers this issue on the Government Electronic Information Portal as follows:
Circular No. 20/2023/TT-BGDDT dated October 30, 2023 of the Ministry of Education and Training stipulates job positions and norms for the number of employees in public general education institutions, for secondary schools, the list of job positions for professional titles includes the position "Equipment, testing", while for primary schools, the positions "Equipment, testing", "Equipment" or "Technical staff" are not specified.
Based on the current regulations on probationary regime and salary ranking, the working time of 7 years and 5 months with compulsory social insurance contributions of Ms. H in the old position (if it is determined that there is a similarity in professional expertise with the new position) is the legal basis for proposing exemption from probationary regime and salary ranking corresponding to the actual working time (after deducting probationary time according to the regulations of the new title) instead of having to resume probation from the beginning and enjoy salary grade 1.
Therefore, to ensure legitimate rights, the Ministry of Education and Training requests her to submit a request with supporting documents (labor contract, social insurance book) to the competent agency managing public employees for consideration, appraisal and adjustment of the salary ranking plan according to legal regulations.
