Ms. Tran Thanh asked, the concept of 3-5 year old children enjoying universal preschool education policy in Decree No. 277/2025/ND-CP is understood as children in the age range from 36 months to 60 months old or children 3 years old (born in 2023), 4 years old (born in 2022), 5 years old (born in 2021). Are children born in 2020 entitled to benefits?
Regarding this issue, the Ministry of Education and Training answers as follows:
Based on Resolution No. 218/2025/QH15 and Decree No. 277/2025/ND-CP, the Ministry of Education and Training clarifies the age as follows:
Regarding universalization for children aged 3 to 5, Article 2 of Decree No. 277/2025/ND-CP stipulates the subjects of application: "This Decree applies to children aged 3 to 5, preschool education institutions and related organizations and individuals".
Thus, the target children applying and enjoying the policies in Decree No. 277/2025/ND-CP are 3-year-old children (taking the 3-4 year old kindergarten program), 4-year-old children (taking the 4-5 year old kindergarten program). The age of children is calculated by year and the policy is applied in the school year.
Accordingly, 5-year-old children (taking 5-6 year old kindergarten classes), including children born in 2020 in the 2026-2027 school year, are not subject to the application of Decree No. 277/2025/ND-CP.
