Ms. Pham Men is a teacher at the Ethnic Minority Boarding School in a region with particularly difficult socio-economic conditions, currently receiving long-term work allowances according to Decree No. 76/2019/ND-CP.
Ms. Men asked, during the summer vacation, if teachers are still on the unit's payroll, do not quit their jobs, do not transfer jobs and still perform tasks as required by the school or educational management agency, can they continue to receive long-term work allowances in areas with particularly difficult socio-economic conditions?
In case some units temporarily suspend the payment of long-term work allowances for 2 months of summer vacation, is this implementation in accordance with the provisions of Decree No. 76/2019/ND-CP and current guiding documents?
Regarding this issue, the Ministry of Home Affairs answers as follows:
Regimes and policies for teachers working in areas with particularly difficult socio-economic conditions are implemented according to the provisions of Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government. According to this regulation, long-term work allowances are applied to subjects with actual working time in areas with particularly difficult socio-economic conditions according to the provisions of law.
At the same time, the working regime for general education teachers and university preparatory teachers is implemented according to the provisions of Circular No. 05/2025/TT-BGDĐT dated March 7, 2025 of the Minister of Education and Training.
During the summer vacation, teachers still perform tasks according to the requirements of the job position, including participating in training and professional development, participating in the high school graduation exam, enrollment work and other tasks when summoned by competent authorities. Thus, the summer vacation time is still defined as the time teachers perform tasks according to regulations.
Based on the above regulations, Ms. Pham Men is requested to contact the agency managing cadres, civil servants, and public employees (Department of Home Affairs) for answers.
