One of the new points of the draft Law on Teachers that is receiving attention is that the Ministry of Education and Training proposes a number of regulations prohibiting organizations and individuals from engaging in certain behaviors related to teachers.
Clause 2, Article 13 of the draft stipulates: Organizations and individuals are strictly prohibited from committing the following acts:
Insulting the honor, dignity, and violating the body of teachers;
Obstructing the professional activities of teachers;
Assigning teachers not in accordance with the agreement and commitment in the teaching contract;
Discrimination among teachers in any form;
Paying salaries not in accordance with the contract; not fully and promptly implementing the teacher's regime and policies as prescribed;
Disclose information about teachers' violations when there is no official conclusion from a competent authority during the process of considering discipline or prosecuting the teacher's legal responsibility and in cases where the violations are not serious enough to require revocation of the teaching license.
Thus, the Draft Law on Teachers mentions prohibited acts for organizations and individuals in their relations with teachers. There are 06 prohibited acts ranging from insulting the honor and dignity of teachers to discriminating between them. This provision also demonstrates the law's commitment to ensuring teachers, creating a positive and fair working environment for teachers.
Commenting on the draft Law on Teachers, Associate Professor Dr. Tran Thanh Nam, Vice Principal of the University of Education, Vietnam National University, Hanoi, said that in order to enhance the status of teachers, it is necessary to have stricter regulations on prohibited acts by organizations and individuals against teachers.
Accordingly, not only is the act of “insulting the honor, dignity, and violating the body of teachers” strictly prohibited, but also all other forms of psychological pressure and manipulation; for example, not cooperating, not cooperating, or creating a hostile, fearful environment…
In addition, even when the case has been concluded, it is necessary to inform carefully, without revealing or publicly disclosing the exact identity so that the individual may no longer meet the standards to be a teacher but still have the opportunity to work in another profession.
The draft Law on Teachers consists of 9 chapters and 71 articles, closely following 05 policies approved by the Government in Resolution No. 95/NQ-CP of the Government in 2023. The purpose of building the Law on Teachers is to institutionalize the guidelines, policies and policies of the Party and State on teachers, especially the viewpoint that "educational development is the top national policy", teachers "play a decisive role in ensuring the quality of education"; developing a team of teachers with sufficient quantity and good quality is the focus and continuity; building a team of teachers, creating motivation for teachers, learners and honoring teachers; contributing to perfecting the legal system on education.
As planned, the draft Law on Teachers will be submitted to the National Assembly for consideration and first comments at the 8th session (October 2024) and considered and approved at the 9th session (May 2025).
