At the 8th session of the 15th National Assembly, on November 9, the draft Law on Teachers will be submitted to the National Assembly for its first comments.
A notable new point in this 5th draft of the Teachers Law is the content of teacher recruitment.
Accordingly, the authority to recruit teachers in public educational institutions is chaired by the educational management agency or delegated to the educational institution.
For educational institutions granted autonomy, the principal is responsible for recruitment.
For non-public educational institutions, recruitment is conducted by the school according to the school's regulations on organization and operation.
The draft also stipulates that, regarding the mobilization, arrangement and appointment of teachers, educational management agencies shall take the lead in advising, deciding or recognizing according to assigned authority.
Currently, the recruitment of public teachers is carried out like the recruitment of civil servants in general, by the Department of Home Affairs and the People's Committees at the district/provincial level. This process reveals a number of difficulties and limitations in the planning of staff development, selection, use, management, training, fostering, evaluation, classification, and implementation of preferential treatment for the teaching staff. Therefore, the delegation of the right to recruit and use teachers to the Education sector is considered by many experts to be a breakthrough in the draft Law on Teachers.
Prof. Dr. Thai Van Thanh - Director of the Department of Education and Training of Nghe An province - said that assigning responsibility and initiative in recruiting and using teachers to educational management agencies can solve current difficulties and limitations such as: The current assigned teaching staff at all levels is still lacking compared to the standards prescribed by the Ministry of Education and Training; The teacher structure is not reasonable, the situation of local surplus and shortage in some subjects at primary, secondary and high school levels due to the implementation of the 2018 General Education Program...
However, to make recruitment truly effective, Prof. Dr. Thai Van Thanh proposed to regulate the content, form and requirements on conditions and recruitment standards specifically for teachers, to ensure that it is suitable for the characteristics of the teacher's profession, to minimize administrative and public service requirements, and to strengthen requirements and assessments of pedagogical capacity.
Regarding recruitment authority, the educational institution is delegated to carry out recruitment if it meets the requirements. In case it does not meet the requirements, the educational management agency directly managing the educational institution will carry out recruitment.
When a teacher is appointed as an educational manager, he/she must have the opinion of the educational management agency directly managing the teacher. In addition, it is also necessary to calculate and stipulate the retention of some teacher policies for teachers appointed as educational managers.
