The Draft Law on Teachers is receiving a lot of expectations and anticipation from teachers across the country. The draft has many new points related to teachers' rights that teachers need to understand.
Teachers continue to receive seniority allowance
Article 27 of the Draft Law on Teachers clearly stipulates salaries and allowances for teachers.
Accordingly, teachers' salaries in public educational institutions are as follows:
Teachers' salaries are ranked highest in the administrative career salary scale system;
Vocational allowances and other allowances depending on the nature of the job and the region as prescribed by law;
Preschool teachers; teachers working in particularly difficult areas such as ethnic minority areas, mountainous areas, coastal areas and islands; teachers at specialized schools and other specialized schools; teachers implementing inclusive education; teachers who are ethnic minorities and teachers in certain specific professions are given priority in terms of salary and allowances compared to other teachers;
Teachers recruited and ranked for the first time will be ranked 1 salary level higher in the administrative career salary scale system.
Salaries and salary policies of teachers in non-public educational institutions are guaranteed to be no less than salaries and salary policies of teachers in public educational institutions with the same training level and same title, unless otherwise agreed.
Teachers working in sectors and fields with special policies are entitled to special policies according to regulations and are only entitled to the highest level if that policy coincides with the policy for teachers.
The Government specifies in detail the salaries and allowances for teachers.
The new draft no longer includes the content that teachers are entitled to seniority allowances, however, Clause 2, Article 50. Transitional regulations state: "Teachers continue to be entitled to seniority allowances until the implementation of the salary policy according to Resolution 27-NQ/TW dated May 21, 2018 of the 7th Conference of the 12th Party Central Committee on reforming salary policy for cadres, civil servants, public employees, armed forces and employees in enterprises".
Do not publicize teachers' violations without a conclusion.
According to the latest draft, at Point c, Clause 3, Article 11, it stipulates what organizations and individuals are not allowed to do with teachers: "not disclosing information during the inspection, examination, and handling of violations when there is no official conclusion or spreading or disseminating inaccurate information about teachers".
Teaching practice is a mandatory content in teacher recruitment.
Article 16 of the Draft Law on Teachers regulates the recruitment of teachers. Regarding the content and method of recruitment:
Recruitment content is based on teacher professional standards;
Recruitment method is through selection or examination, which must include pedagogical practice.
Regarding the expected recruitment authority:
Teachers in public educational institutions are recruited by the educational management agency in charge or delegated by the authority. For educational institutions granted autonomy, the head of the educational institution carries out the recruitment;
Teachers in non-public educational institutions are recruited by the educational institution in accordance with the regulations on organization and operation of the educational institution.
