Sending questions to the Hanoi City Electronic Information Portal, reader N.T. T. H reflected: In the 2023-2024 school year, the school organizes 2 sessions/day (with fee). Readers are assigned to be homeroom teachers of grade 4, with a total of 33 periods/week. Among them, 8 periods belong to specialized subjects including: Music (1 period), Fine Arts (1 period), English (4 periods), Informatics and Technology (2 periods). In fact, teachers directly teach 25 periods/week.
Readers are concerned whether the above-mentioned teaching volume will be entitled to overtime teaching benefits or not. At the same time, in this school year, teachers are also assigned to concurrently teach Physical Education subjects (while the school has subject teachers), so it is requested to clarify whether overtime teaching fees, practical training allowances and clothing allowances will be paid to Physical Education teachers or not.
In the 2025-2026 school year, readers will continue to be assigned to be the homeroom teacher of grade 4. The school still organizes 2 sessions/day (free of charge), with a total number of teaching periods as assigned of 717 periods/school year. Hanoi City Center for Communication, Data and Digital Technology answers: Clause 3, Article 3 of Circular No. 21/2025/TT-BGDĐT dated September 23, 2025 stipulates the calculation of overtime teaching salaries as follows:
Article 3. General regulations on calculating overtime teaching salaries

3. Total number of extra classes in a school year of each teacher
a) The total number of extra teaching hours in a school year of each teacher calculated to pay overtime pay is no more than 200 hours, except for the cases specified in point b of this clause;
b) In case the total number of extra teaching periods in a school year of teachers exceeds 200 periods because the subject cannot arrange enough teachers to teach, the head of the educational institution must notify in writing to the competent authority.
In Clause 2, Clause 3, Article 4 of Circular No. 21/2025/TT-BGDĐT stipulating the number of extra teaching hours:
Article 4. Total number of extra classes in a school year

2. The total number of extra classes in a school year for teachers is determined as follows:
Number of extra teaching hours of teachers/school year = (Total number of teaching hours calculated in reality/school year) - (Level of teaching hours/school year).
In which:
a) The total number of actual teaching periods/school year includes: the number of actual teaching periods/school year; the number of converted teaching periods/school year according to regulations (if any); the number of additional teaching periods/school year according to regulations (if any); the number of reduced teaching periods/school year according to regulations (if any); the number of teaching periods included in the number of full teaching periods/school year according to regulations (if any).
For teachers assigned to teach on assignment or inter-school, the number of practical teaching periods/school year is the total number of practical teaching periods/school year in all educational institutions where teachers participate in teaching;
b) Lesson norms/school year for preschool teachers = (Number of norm teaching hours/day) x (Number of working days/week) x (Number of weeks teaching children/school year);
c) Lesson norms/school year for teachers of other educational institutions are implemented according to current regulations on the working regime of teachers;
d) In case there are no regulations on lesson norms/school year for teachers, the head of the educational institution shall stipulate in writing after agreeing with the collective of teachers and management staff of the educational institution.
3. Based on the total number of extra teaching hours maximum in a school year that the educational institution is paid for extra teaching hours and the number of extra teaching hours of each teacher, the head of the educational institution decides the number of extra teaching hours of each teacher to be paid to ensure the principles specified in Clause 3, Article 3 of this Circular.
Point a, clause 1, clause 2, clause 3, clause 4 of Article 5 of the above Circular stipulates:
Article 5. Overtime teaching salary
1. The salary for 01 teaching hour of teachers is determined as follows:
a) For teachers in preschool education institutions, general education institutions, continuing education institutions, university preparatory schools, specialized schools and vocational education teachers:

2. Salary for 1 tutoring hour = Salary for 1 teaching hour x 150%.
3. Overtime salary/school year = Number of overtime periods/school year x Overtime salary for 1 overtime period.
4. Overtime pay for teachers specified in Clause 2, Article 2 of this Circular shall be implemented in accordance with the regulations on overtime pay of labor law.
