Rights of school staff when subject to resignation
Reader Anh Linh (Hanoi) asked: "What allowances do school staff who are subject to dismissal due to arrangement receive, and what are their social insurance benefits?
Answering the question of Lao Dong Newspaper readers, Lawyer Hoang Ha (Ho Chi Minh City Bar Association) said: If school staff (accountants, clerical staff, school libraries...) are subject to streamlining and immediate resignation, according to Clause 1, Article 8 of Decree 154/2025/ND-CP, they will enjoy two main benefits:
Including a 3-month current salary allowance for job search and a 1.5-month current salary allowance for each year of work with compulsory social insurance (BHXH) contributions.
Regarding social insurance, the paid time is not lost. Dismissed people are allowed to choose to preserve the compulsory social insurance contribution time so that it can be added later when they continue to participate or are eligible to receive a pension, or can receive one-time social insurance benefits if they meet the conditions of the law on social insurance.
