Mr. Tran Vinh Thuy (Tay Ninh) is a secondary school teacher, who has taught enough 19 periods/week according to the provisions of Circular No. 05/2025/TT-BGDĐT. The school assigned him to tutor excellent students for 2 more periods/week.
According to school regulations, 1 tutoring period for excellent students is converted to 1 quotation period. Thus, Mr. Thuy teaches a total of 21 periods/week.
Mr. Thuy asked, are 2 extra periods due to tutoring excellent students paid for increased hours according to Circular No. 21/2025/TT-BGDĐT or only paid for 1 standard period?
Regarding this issue, the Ministry of Education and Training said that the overtime teaching salary payment regime for teachers in public educational institutions is implemented according to the provisions of Circular No. 21/2025/TT-BGDDT dated September 23, 2025 of the Minister of Education and Training. In which, according to the provisions of Clause 7, Article 3 of Circular No. 21/2025/TT-BGDDT, the overtime teaching salary payment regime for teachers in public educational institutions, the time of payment of overtime teaching salaries to teachers is implemented after the end of the school year.

According to the provisions of Clause 2, Article 4 of Circular No. 21/2025/TT-BGDĐT, the salary regime for overtime teaching for teachers in public educational institutions, the total number of overtime teaching periods in a school year of teachers is determined by the total number of teaching periods actually calculated in the school year minus the teaching period norm in the school year.
The total number of actual teaching periods/school year includes: the number of actual teaching periods/school year; the number of converted teaching periods/school year according to regulations (if any); the number of additional teaching periods/school year according to regulations (if any); the number of reduced teaching periods/school year according to regulations (if any); the number of teaching periods included in the number of full teaching periods/school year according to regulations (if any).
Clause 5, Article 3 of Circular No. 21/2025/TT-BGDĐT stipulates that tasks that have received remuneration or allowances are not allowed to convert the time of task performance to teaching hours or reduce teaching hours norms to calculate overtime salaries unless otherwise provided by law.
Based on the above regulations, the determination of the total number of overtime teaching periods of teachers is carried out after the end of the school year, not carried out weekly. The number of overtime teaching periods is determined based on the total number of teaching periods actually calculated in the school year and the teaching period norms in the school year.
