Regarding this issue, the Ministry of Education and Training said that the seniority allowance regime for teachers is implemented according to the provisions of Decree No. 77/2021/ND-CP dated August 1, 2021 of the Government. Accordingly, teachers with a teaching and educational time with compulsory social insurance contributions of 5 years (60 months) are entitled to seniority allowances equal to 5% of the current salary plus leadership position allowance and seniority allowance beyond the frame (if any). From the sixth year onwards, each year (12 months) is calculated an additional 1%.
In case Ms. Le Thi To Huyen has 2 years and 6 months of teaching duties at a primary school and has paid compulsory social insurance before being appointed to the professional title of Primary School Teacher rank III, this time is included in the time for calculating seniority allowance for teachers according to regulations.
Therefore, when appointed to the professional title of primary school teacher from June 2023 and directly performing teaching and education tasks, the above-mentioned teaching time is accumulated with the teaching and education time with compulsory social insurance contributions after being appointed to serve as a basis for calculating seniority allowances for teachers.
After accumulating the periods of time eligible for seniority allowance for teachers according to regulations, when reaching 5 years (60 months), excluding probationary time, Ms. Le Thi To Huyen is entitled to seniority allowance for teachers according to the provisions of Decree No. 77/2021/ND-CP.
