There are no instructions for registering individual business households for tutoring.
In recent days, public opinion has focused on the regulations on extra teaching and learning according to Circular 29/2024 of the Ministry of Education and Training (the Circular takes effect from February 14, 2025).
Some new points of Circular 29: Prohibition of extra tutoring for primary school students; extra tutoring organized at school, only for 3 groups of students: students who do not meet the learning requirements in the previous semester, excellent students who need extra training (for exams), final year students who voluntarily register; prohibiting teachers from collecting extra tuition fees from their regular students; for extra tutoring outside of school, teachers must register as individual business owners - if teaching at home; or teachers must register to teach extra at a center.
The Ministry of Education and Training emphasized that the ministry does not prohibit extra teaching and learning, Circular 29 only corrects violations related to the organization of teaching and learning besides the main curriculum; it is not called "extra teaching and learning" but "knowledge supplementation".
Speaking to Lao Dong, Mr. Tung - a Physics teacher at a high school in Ba Dinh district (Hanoi) said that after the announcement of the Ministry of Education and Training, the school has thoroughly grasped and implemented Circular 29 on extra teaching and learning. Most teachers have stopped extra teaching activities to wait for official instructions from all levels.
According to Mr. Tung, Circular 29 is a solution to end the distortions and negativity in extra teaching and learning. From there, students will no longer be pressured by teachers forcing them to take extra classes, parents will no longer be upset about the costs, and at the same time, it will help preserve the respectable image of teachers.
However, after studying Circular 29, Mr. Tung wondered if teachers who want to teach extra classes must register as individual businesses and pay taxes in full. Mr. Tung said, "This is the right and appropriate thing to do." However, there are no specific instructions from the Department of Education and Training on how to register.
“Up to now, there are no instructions for registering individual business households in the field of education and teaching, so teachers have to figure it out themselves and consult with lawyers,” said Mr. Tung.

According to Mr. Tung, through self-study, he learned that to register a sole proprietorship, he needs to prepare a business registration application; citizen identification card, lease contract, or borrowing of a business location...
When all of these documents are available, they can be submitted directly to the Finance - Planning Department of the District People's Committee where the business headquarters is located; or submitted online on the business registration information system of the National Business Registration Information System through the National Business Registration Information Portal.
Another thing that makes Mr. Tung wonder is whether teachers are allowed to organize extra classes online or not? Because according to the regulations of Circular 29, online teaching is not mentioned. Many of my colleagues stopped teaching extra classes at home but have switched to tutoring students online since after Tet and charge tuition fees."
The Department of Education and Training must direct more closely.
Dr. Nguyen Tung Lam - Chairman of the Education Council of Dinh Tien Hoang High School (Hanoi) said that Circular 29 must be considered a test to force schools to change. Circular 29 has put forward scientific and humane policies to solve the negative phenomena of the "disease" of extra teaching and learning that has existed for a long time.
Nowadays, we are studying hard for degrees, transcripts, studying to choose schools, serving immediate goals. This makes the war with extra teaching and learning never-ending because this is a real need. Moreover, the lack of schools and uneven school quality creates a race to get into better schools.
Dr. Nguyen Tung Lam said that the Department of Education and Training must give closer instructions, requiring teachers to help students learn how to study on their own, not just use extra study time as the main thing. Schools can guide students to teach each other, and when good students know how to study on their own, they can guide weaker students.
The Hanoi Department of Education and Training has also just issued a document requesting schools to strictly implement Circular 29 regulating extra teaching and learning.
The Hanoi Department of Education and Training requests the Department of Education and Training, schools, general education institutions, and vocational education and continuing education centers in the city to seriously and fully implement the contents of Circular No. 29/2024.
The Department also requires localities and educational institutions in the area to disseminate and propagate to cadres, teachers, staff, students and parents regulations on extra teaching in accordance with regulations.
"During the implementation process, if there are any difficulties or problems, it is necessary to promptly inform the Department of Education and Training through the Secondary Education Department" - the Department's document stated.
