Teachers reflect inadequacies in promotion consideration, Ministry of Education and Training responds

Mr. Tran Van Minh is a high school teacher, working for 8 years. Currently, his school still has quotas for grade II High School Teacher consideration, Mr. Minh meets all the conditions for grade II promotion consideration and has a master's degree, so only 6 years of work is needed.

Mr. Minh asked, when there are new regulations on professional standards for teachers, removing promotion consideration, will teachers rank III like him later have the opportunity to be considered for promotion to Principal High School Teachers?

Mr. Minh said that if we stop and do not create conditions for teachers who need to be promoted to higher ranks, it is unreasonable because many teachers, no matter how much they strive, will still only stop as Grade III High School Teachers.

Regarding this issue, the Ministry of Education and Training answers as follows:

According to the provisions of the Law on Civil Servants No. 129/2025/QH15, from July 1, 2026, recruiting, using, and managing civil servants according to job positions is 1 of 5 principles of civil servant management (Clause 2, Article 5 of the Law on Civil Servants No. 129/2025/QH15).

The job position of public employees will be determined according to the functions, tasks and organizational structure of public non-business units; the level of complexity, nature, characteristics, and scale of operation of public non-business units; scope, service objects; professional and nghiệp vụ management processes; professional and nghiệp vụ of the industry or field of professional activities and professional and nghiệp vụ of other industries and fields as prescribed; the level of modernization of means, equipment, working conditions and application of science, technology, and digital transformation.

At the same time, Clause 1, Article 2 of the Law on Civil Servants No. 129/2025/QH15 stipulates that civil servants have the right to receive salaries, bonuses and other incomes based on the results and efficiency of work according to the assigned job position.

In Clause 1, Article 23 of the Law on Civil Servants No. 129/2025/QH15, the National Assembly assigned the Government to detail the job positions of civil servants. Therefore, in the near future, the Government will issue regulations on job positions to implement the Law on Civil Servants to ensure the above principles.

To implement the provisions of the Law on Teachers No. 73/2025/QH15 and ensure general regulations on principles of public employee management in the Law on Public Employees No. 129/2025/QH15, the Ministry of Education and Training is advising the Government to develop a Decree detailing a number of articles of the Law on Teachers and build according to its authority a Circular regulating professional standards for general education teachers, which specifically identifies job positions for teachers in general education schools to clearly show the nature and complexity of task requirements, professional activities and professional and nghiệp vụ requirements of each job position. This is an important basis for implementing the payment of salaries, bonuses and other incomes based on the results and effectiveness of work according to the job position assigned according to the provisions of the Law on Public Employees No. 129/2025/QH15 as mentioned above.
