Ms. Bui Ha Thuong is a teacher, working in commune area III in ethnic minority areas, not in mountainous areas.
The Department of Education and Training is drafting a document guiding the implementation of the decision of the Provincial People's Committee and Decision No. 60/QD-BDTTG dated January 29, 2026 of the Ministry of Ethnic Minorities and Religions, teachers are reduced professional preferential allowances from 35% to 30% and are not entitled to 70% allowance according to Article 11 of Decree No. 76/2019/ND-CP, because this is a commune in Region III, a commune in an ethnic minority area, not belonging to the mountainous region.
Ms. Thuong asked, is the application in accordance with regulations?
Regarding this issue, the Ministry of Home Affairs answers as follows:
Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government on regimes and policies for cadres, civil servants, public employees, laborers and salaried earners in the armed forces working in areas with particularly difficult socio-economic conditions takes effect from December 1, 2019.
In which, Clause 2, Article 1 of Decree No. 76/2019/ND-CP stipulates that cadres, civil servants, public employees, and laborers working in communes in area III of particularly difficult villages are subject to the application and enjoy the regimes and policies specified in Decree No. 76/2019/ND-CP and in Article 3 of the Decree, the principle has been stipulated that in cases where cadres, civil servants, public employees, laborers and salaried people in the armed forces are subject to the policies specified in this Decree, and are also subject to the same type of policies specified in other legal documents, they are only entitled to the highest level of that policy.
Based on the above regulations, it is requested that you contact the management agency to consider and resolve appropriate regimes and policies, ensuring compliance with regulations.
