Mr. Ly Duc Long's locality is implementing the merger of primary and secondary schools. According to the explanation of the Department of Home Affairs, the Principals and Vice Principals of primary schools after the merger are not eligible to continue to work as managers at primary and secondary schools.
The reason is that Clause 3, Article 11 of Circular No. 32/2020/TT-BGDDT dated September 15, 2020 of the Minister of Education and Training stipulates the training level and working time of teachers must meet the standard training level prescribed by the Law on Education for the highest level of education for high schools with many levels of education and have taught for at least 5 years (or 4 years for mountainous areas, islands, highlands, remote areas, ethnic minority areas, areas with particularly difficult socio-economic conditions) at that level.
Therefore, it is necessary to teach for 5 years at the highest level to be Vice Principal of primary and secondary schools. Mr. Long asked, is the above explanation correct?

The standards for Principals and Vice Principals of schools with many levels of education are stipulated in Clause 3, Article 11 of Circular No. 32/2020/TT-BGDDT, specifically as follows:
"Having a teaching period of at least 5 years (or 4 years for mountainous areas, islands, remote areas, ethnic minority areas, areas with particularly difficult socio-economic conditions) at that level of education, meeting the standard training level of teachers according to the provisions of the Education Law for the level of education, and meeting the standard training level at the highest level of education if it is a high school with many levels of education".
According to Conclusion No. 137-KL/TW dated March 28, 2025 of the Politburo on the orientation for the arrangement and reorganization of administrative units at all levels and the construction of a two-level local government model, the reorganization of public service units is carried out in the direction of: " Maintain educational and health service units and transfer them to the commune-level authorities to manage secondary schools, primary schools, kindergartens, and health stations of the newly established units".
In Official Dispatch No. 1581/BGDDT-GDPT dated April 8, 2025 of the Ministry of Education and Training guiding localities to implement state management of education when implementing the two-level local government model. Accordingly, public kindergartens, primary schools and secondary schools are kept unchanged and transferred to the commune-level government for management.
While the Ministry of Education and Training is studying the amendment of Circular No. 32/2020/TT-BGDDT, in order to ensure stability of the management team and maintain smooth educational activities when implementing the arrangement of administrative units according to Conclusion No. 137-KL/TW dated March 28, 2025, the Ministry requests the Department of Education and Training to consult with the Provincial People's Committee and coordinate with relevant departments and branches to maintain the status quo of public service units in the education sector.
