Driving license is deducted at least 2 points, maximum 10 points
Decree No. 168/2024/ND-CP, regulating administrative sanctions for violations in the field of road traffic, deduction of points, and restoration of driving license points, will officially take effect from January 1, 2025. This Decree will replace Decree 100/2019/ND-CP (amended and supplemented by Decree 123/ND-CP).
Decree 168 has many notable adjustments in fines. Some violations and groups of violations that are direct causes of traffic accidents have their fines increased many times compared to current levels, such as running red lights, driving in the wrong direction, opening car doors without ensuring safety, etc.
In addition to increasing the penalty level, the authorities also stipulate a new form of penalty compared to the current one, which is deducting driving license points.
Article 58 of the 2024 Law on Road Traffic Order and Safety clearly states that driving license points are used to manage drivers' compliance with laws on road traffic order and safety on the road traffic order and safety database system, including 12 points.
Clause 2, Article 58 of the 2024 Law on Road Traffic Order and Safety stipulates that the number of points deducted from the driver's license for each violation depends on the nature and severity of the violation of the law on road traffic order and safety.
"Depending on the nature of the violation, the driver will be deducted a minimum of 2 points and a maximum of 10 points (the previous draft was a maximum of 12 points). For dangerous acts that violate road traffic safety and order, the authorities will apply the form of immediate revocation of the driver's license," informed a representative of the Traffic Police Department (Ministry of Public Security).
For example, with alcohol concentration violations, for car drivers, if the violation is at level 1 (not exceeding 50 milligrams/100 milliliters of blood or not exceeding 0.25 milligrams/1 liter of breath), in addition to being administratively sanctioned, 4 points will be deducted from the driver's license.
At level 2 (exceeding 50 milligrams to 80 milligrams/100 milliliters of blood or exceeding 0.25 milligrams to 0.4 milligrams/1 liter of breath) 10 points are deducted.
However, a level 3 violation (exceeding 80 milligrams/100 milliliters of blood or exceeding 0.4 milligrams/1 liter of breath) will immediately revoke the driver's license for 22 - 24 months.
In cases where all points in the driving license are deducted, after a period of at least 6 months from the date of deduction of all points, the person with a driving license is allowed to participate in the test on legal knowledge on road traffic order and safety as prescribed in Clause 7, Article 61 of this Law organized by the Traffic Police force, and if the result is satisfactory, the full 12 points will be restored.
Traffic police ready to implement new regulations
According to Colonel Nguyen Quang Nhat - Head of the Traffic Accident Investigation, Dispute Resolution and Propaganda Guidance Department (Traffic Police Department), the Department and the Traffic Police force nationwide have completed training, developed plans, reviewed and arranged forces and means to disseminate information to the people and are ready to strictly handle violations according to the provisions of the new Decree.
The databases used to deduct driving license points have also been connected.
During the process of handling violations, the Traffic Police force will prioritize the use of surveillance systems, handheld cameras, and body-worn cameras of officers and soldiers to record propaganda, remind, and handle traffic participants, contributing to gradually forming good habits when participating in traffic, building a civilized and safe traffic system.
Authorities also recommend that people should update their driver's license connection with the VNeID application to easily track their driver's license points and status.
For each officer and soldier, when performing their duties, the law must be upheld, there are no forbidden zones, no exceptions. Any violations will be strictly handled according to the provisions of the law and the Public Security sector.
