On September 17, Prime Minister Pham Minh Chinh signed and issued Directive No. 35/CT-TTg on handling cadres, civil servants, public employees and soldiers in the armed forces who violate regulations on driving vehicles while having alcohol concentration in their blood or breath.
According to the directive, in the past, there were still a number of cadres, civil servants, public employees, officers and soldiers in the armed forces who lacked exemplary behavior and violated the law when participating in traffic.
There are even substandard behaviors, not complying with inspection and handling by authorities, especially in checking violations of driving vehicles with alcohol concentration in blood or breath (alcohol concentration violation).
There are some cases of drivers violating alcohol concentration causing traffic accidents resulting in death, fleeing the scene, resisting and not cooperating with the inspection and handling of the authorities, causing public outrage.
In 2023 and the first quarter of 2024 alone, the police force inspected, handled administrative violations, and verified and sent notices to management agencies and units for more than 7,600 party members, cadres, civil servants, and public employees who violated alcohol concentration.
The Prime Minister requests Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally run cities:
When there is a notice from a competent authority about a cadre, civil servant or public employee under its management violating alcohol concentration and not cooperating with the authorities in handling the violation, the cadre management agency, based on the provisions of the law on disciplining cadres, civil servants and public employees and the specific regulations of the agency or unit, must strictly implement the handling procedure according to the regulations.
The handling must ensure objectivity, fairness, publicity, strictness, accuracy, timeliness, proper authority, order and procedures, strictly prohibiting the covering up or concealment of shortcomings of violating cadres, civil servants and public employees.
Annually (before October 15), exchange disciplinary action results with the agency sending the violation notice to summarize and report to the Prime Minister.
Consider the responsibility of the head, the head of the agency, the unit directly employing the cadres, civil servants, and public employees who have many people violating alcohol concentration, not complying with orders and requests of the law enforcement force, or not strictly or promptly handling cadres, civil servants, and public employees who have violated their management authority.
The Minister of Public Security directed the Public Security of units and localities to comply with the spirit of "rule of law", "no forbidden zones, no exceptions", and not accept intervention or influence to ignore violations during patrolling, checking, and handling of traffic violations.
In particular, strictly discipline officials who do not thoroughly handle or ignore violations in the process of handling administrative traffic violations.
The handling process must be verified. If the violator is a cadre, civil servant, or public employee who violates the alcohol concentration while driving a vehicle and does not cooperate with the authorities in handling the violation, the agency or unit managing the cadre must be notified for consideration and handling in accordance with regulations.
Propose that the Supreme People's Procuracy and the Supreme People's Court direct the Procuracy and the Court at all levels to coordinate with the investigation agencies to strictly handle cases of cadres, civil servants and public employees violating alcohol concentration causing serious accidents or having acts of opposition, disturbing public order, and obstructing the performance of duties of functional forces.
