On September 19, in Hanoi, the Standing Committee of the Economic and Financial Committee held an expanded meeting to review the draft Law on Deposit Insurance (BHTG) amendment.
According to the Draft Law Submission presented by the Director of the Legal Department, State Bank Ta Quang Don, the current Law on Unemployment Insurance is amended to create a complete and clear legal framework for the organization of unemployment insurance to better protect the rights of depositors.
In addition, ensure the stability of the credit institution system (CIs), security and social safety.
Accordingly, the draft Law supplements the rights and obligations of unemployment insurance organizations (special dispatch from the State Bank; participation in the process of handling organizations participating in unemployment insurance...).
Assign the Governor of the State Bank to regulate the unemployment insurance fee, the application of the unemployment insurance fee mechanism of the same or different rates in accordance with the characteristics of the Vietnam credit institution system in each period.
The draft Law also adjusts regulations on organization model, operation, operating capital, financial regime, accounting, and accounting of unemployment insurance organizations.
The Government stipulates the organization and operation of unemployment insurance organizations in accordance with the nature of the operation of unemployment insurance organizations.
At the same time, the draft Law also expands the forms of investment of unemployment insurance organizations, and adds regulations to limit risks in investment activities of unemployment insurance organizations.
Delegates agreed with the amendment of the current Law on Unemployment Insurance, with the reasons given in the Government's Submission; at the same time, it is noted that it is necessary to review the provisions regulating implementation procedures to simplify collection and payment of unemployment insurance.
In addition, it is necessary to review the authority of the State Bank as stipulated in the State Bank Law, avoiding the regulation of overlapping the functions of the unemployment insurance organization with the State Bank.
National Assembly delegate working full-time at the Economic and Financial Committee Nguyen Tuan Anh said that it is still necessary for the Prime Minister to regulate the current unemployment insurance fee framework, to ensure transparency in implementation.
In addition, the delegates also suggested that the drafting agency consider regulations on the form of penalty for late payment of unemployment insurance fees.
The delegates also suggested that it is necessary to continue reviewing and studying international experience to perfect regulations on investment activities, because with the specific nature of the unemployment insurance organization, it is necessary to raise the requirement to ensure safer development of capital for this organization.
Concluding the meeting, Permanent Vice Chairman of the Economic and Financial Committee Le Quang Manh suggested that the drafting agency continue to review and revise the draft Law to ensure that the draft Law only stipulates major, stable issues under the authority of the National Assembly.
Continue to review promulgated laws and draft laws submitted to the National Assembly at the 10th Session to ensure consistency and feasibility in the legal system.
