Mr. D.N.D in Hanoi reflected that he plans to install a self-produced, self-consumed rooftop solar power system with a capacity of 2 MW on the factory roof.
Through research, Mr. D learned that Decree No. 175/2024/ND-CP (amended to Decree 06/2021/ND-CP) stipulates that solar power equipment mounted on the roof of existing works cannot be considered "energy works".
Mr. D asked, so what type of project is this self-produced and self-consumed 2 MW rooftop solar power system installation project and does it require a construction permit when implementing it?
Regarding this issue, the Ministry of Industry and Trade has the following opinion:
At Point b, Clause 1, Article 123 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the law on construction management, stipulates that solar power generation equipment mounted on the roof of a construction work that is not an energy project.
Therefore, self-produced and self-consumed rooftop solar power plants do not have to comply with the regulations as for construction works under the law on construction.
At the same time, the law on electricity does not have regulations on decentralization of works, construction permits for self-produced and self-consumed rooftop solar power sources.
