From February 9, 2026, Decree No. 340/2025/ND-CP regulating administrative violations in the monetary and banking sector officially takes effect.
In which, the Decree stipulates penalties for the production and trading of gold bars and raw gold materials without a license.
Accordingly, the confiscation of gold bars traded without a license is applied according to Clause 8, Clause 9, Article 28 of Decree 340/2025/ND-CP.
A fine of between 300,000,000 VND and 400,000,000 VND shall be imposed for one of the following violations:
a) Production and business of buying and selling gold bars but without a license for production and business of buying and selling gold bars;
b) Exporting or importing raw gold and gold bars without a license issued by a competent state agency in accordance with the law;
c) Other gold business activities when they have not been licensed by competent authorities in accordance with the law.
Additional forms of penalties:
a) Confiscating gold for violations specified in Clause 8 of this Article;
b) Suspending business activities of buying and selling gold bars for a period of 06 months to 09 months for acts of violating the provisions of point a, clause 5 of this Article;
c) Suspending import activities of raw gold materials for a period of 09 months to 12 months for acts of violating the provisions of point a, clause 6 of this Article.
Thus, from February 9, 2026 (according to Decree 340/2025/ND-CP), the confiscation of gold bars traded without a license applies to cases including:
- Production and business of buying and selling gold bars but without a license for production and business of buying and selling gold bars;
- Exporting or importing raw gold and gold bars without a license issued by a competent state agency in accordance with the law;
- Other gold business activities when not yet licensed by competent authorities in accordance with the law.
