Article 10 of Decree No. 296/2025/ND-CP stipulating the enforcement of administrative violation sanctioning decisions (effective from January 1, 2026) stipulates the subjects subject to the coercive measure of deducting a part of salary or a part of income as follows:
1. Individuals subject to coercive measures are cadres, civil servants, public employees, people belonging to the People's Army, People's Police, people working in the Key Organization; individuals currently working and receiving salaries or income at an agency, unit, organization or having short-term seasonal income hired by households, business households, and employers.
2. Individuals subject to coercive measures are enjoying retirement benefits according to the provisions of social insurance law.
Article 13 of Decree No. 296/2025/ND-CP stipulates the rate of deduction of part of salary or part of income for individuals subject to coercive measures as follows:
The deduction of a part of salary or a part of income can be carried out multiple times, in the following ratios:
1. For salaries and pensions, the deduction rate each time does not exceed 30% of the total monthly actual salary and pension paid after deducting and paying social insurance, health insurance, unemployment insurance, personal income tax and must ensure the minimum living conditions of that person and the person being nurtured in accordance with the law.
2. For other income items, the deduction rate each time does not exceed 50% of the total monthly income, but must ensure the minimum living conditions of that person and the person being nurtured according to the provisions of law.
Thus, from January 1, 2026, individuals may be deducted salary and income to be forced to pay administrative fines according to the above regulations.
