Latest penalty level applied from March 2026

The Government has officially issued Decree 31/2026/ND-CP regulating penalties for administrative violations in the field of archiving. This legal document will take effect from March 8, 2026.

The new regulation is assessed as a drastic step to rectify the work of storing documents and records that are still inadequate at units, organizations and business establishments today.

How are business households penalized?

This is a question of many small business owners. In Decree 31/2026/ND-CP, regulations clearly state that the fine level for business households and households with administrative violations in the field of archiving will be applied as the fine level for individuals.

The monetary penalty framework is clearly divided:

For individuals (including business households): The maximum fine is 30,000,000 VND.

For organizations: The maximum fine is up to 60,000,000 VND.

Thus, if they commit the same violation of storage, the penalty applied to businesses (organizations) will be 02 times higher than for business households or individuals.

Risk of being revoked the Certificate of Recording Practice

In addition to the form of fines, violators are also facing strict additional penalties. Specifically, functional agencies have the right to revoke the right to use the Certificate of practice of archiving for a period of 03 months to 06 months.

In addition, violators are required to implement remedial measures according to the provisions of the Law on Handling of Administrative Violations and specific clauses (from Article 6 to Article 13) of this Decree.

Tightening management of electronic storage

Decree 31/2026/ND-CP also updates sanctions for violations in digital space. Handling administrative violations in the field of storage on the electronic environment will be implemented according to current regulations (Decree 118/2021/ND-CP, Decree 68/2025/ND-CP and Decree 190/2025/ND-CP).

This requires business households and organizations that are storing digitalized records to review their security procedures and data storage before March 8, 2026.

Notes on penalty principles

If organizations and individuals commit violations against many archived documents that have been detected but have not been handled: Only one administrative violation will be sanctioned for that act. But the aggravating circumstance of "multiple administrative violations" will be applied.
