Regarding the case of Lang Son functional forces temporarily detaining a shipment of cicada carcasses on a passenger car that caused a stir on social networks in recent days, on the afternoon of May 13, the case had final handling results.
Talking to PV, Mr. Chu Ngoc Ha - Head of Market Management Team No. 1 (Lang Son Provincial Market Management Sub-Department) said that the owner of the batch of 80kg of dried cicada carcasses had directly worked with functional agencies.
Here, this person provided complete dossiers, purchase lists and related documents to prove the origin of the above-mentioned medicinal herbs.
After the process of inspection, appraisal and comparison of documents provided by the cargo owner, functional forces determined that the dossier basically met all and fully the requirements according to the provisions of law.
Therefore, Market Management Team No. 1 proceeded to make a record, complete the handover procedures and return the entire 80kg of dried cicada carcasses to the owner intact.
Team Leader of Market Management Team No. 1 emphasized the principle of handling: "When the cargo owner provides valid documents, proves the legal origin of the batch of medicinal materials, functional forces will complete the procedures to return the goods. Conversely, if the origin cannot be proven, both the cargo owner and the transportation unit may be strictly handled according to regulations.
Previously, at about 9:30 am on May 10, at Km21 National Highway 1A (section passing Dong Kinh ward, Lang Son city), functional forces inspected Phong Hien passenger car running the Son La - Lang Son route and discovered 9 sacks containing 80kg of dried cicada carcasses.
Because the driver was only a hired transporter and could not present invoices and documents at the time of inspection, functional forces temporarily seized the shipment for verification.
This process has been filmed and spread online with many words guiding public opinion, causing misunderstanding that functional agencies are "making it difficult" for people to pick up natural products.
Reviewing the entire case, Dr. Dang Van Cuong (Head of Chinh Phap Law Office) assessed: "The fact that the Market Management force made a record and temporarily seized the shipment without papers at the time of circulation is an accurate and necessary professional measure. This measure aims to prevent goods of unknown origin from mixing into the medicinal material market, protecting consumer safety".
The lawyer further analyzed that the law does not prohibit people from picking up ve sầu (Thuyền thoái) carcasses naturally for use.
However, when collected in large quantities up to nearly 1 quintal, to serve commercial purposes, this product becomes a commercial good and must comply with the Commercial Law.
