These documents will continue to be effective from April 16, 2026. During the suspension period as mentioned above, Decree 15/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of a number of articles of the Law on Food Safety and documents regulating and guiding the implementation of this Decree continue to be effective.
Resolution No. 09/2026/NQ-CP takes effect from February 4, 2026. Before April 16, 2026, the Ministries of Health, Agriculture and Environment, Industry and Trade, Finance, ministries, relevant agencies, and People's Committees at all levels are responsible for ensuring full necessary conditions for implementing Decree No. 46/2026/ND-CP and Resolution No. 66/13/2026/NQ-CP.
Previously, on February 3, 2026, Prime Minister Pham Minh Chinh signed Official Dispatch No. 08/CD-TTg on focusing on removing difficulties and obstacles in organizing the implementation of Decree No. 46/2026/ND-CP of the Government detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety.
In which, it is required to immediately issue guiding documents for the implementation of Decree No. 46 on inspection of food and goods exported and imported; urgently resolve the situation of congestion at some border gates, and ensure timely customs clearance of food and goods exported and imported.
At the regular Government meeting in January 2026 on the afternoon of February 4, Prime Minister Pham Minh Chinh requested to urgently develop and immediately issue a Government Resolution to remove current obstacles related to Decree No. 46/2026/ND-CP, resolutely not to let this situation drag on.
At the same time, the Prime Minister once again reminded ministries, sectors, and agencies to pay close attention to the requirement that management is not abrupt, when issuing legal normative documents, it is necessary to stipulate specific transitional clauses.
Immediately after Resolution No. 09/2026/NQ-CP took effect, the situation at some border gates has clearly changed.
On February 5, in an exchange with reporters, a representative of Kim Thanh Border Gate Border Guard Station (Lao Cai) said that the unit has closely coordinated with customs, quarantine and inter-sectoral forces to regulate vehicles and organize reasonable traffic diversion for customs clearance vehicles.
According to a representative of the Border Guard Station, the main cause of the congestion stems from the fact that Decree No. 46/2026 has taken effect while there is no detailed guidance document on inspection methods, sampling procedures and testing time.
The quick clearance at Kim Thanh Border Gate not only helps relieve the flow of goods but also contributes to reducing pressure on import and export activities, limiting damage to businesses and people.
