The People's Committee of Luc Yen commune has just issued a decision to administratively sanction Hung Dai Son Construction, Production and Trading Service Company Limited for encroaching on agricultural land, special-use forest land, protective forest and production forest.
Accordingly, Hung Dai Son Construction, Production and Trading Service Company Limited (headquartered in village 7, Luc Yen commune, Lao Cai province), with Mr. Nguyen Van Hung as director and legal representative, has encroached on more than 4.7 hectares of agricultural land and rocks outside the licensed boundary.
The violating area is a safety corridor and auxiliary works have not been leased land by the competent authority.
At the time of inspection, the company had built an office, a stone yard and part of the area of land that had been slid down from the above dumping site.
The above behavior was determined to violate Point e, Clause 3, Article 13 of Decree 123/2024/ND-CP dated October 4, 2024 of the Government on administrative sanctions in the field of land.
Hung Dai Son Company was subject to aggravating circumstances because it had previously been punished for the same act under Decision No. 1778 dated August 30, 2024 of the People's Committee of the old Yen Bai province.
According to the penalty decision, the company must pay a fine of VND 400 million and return an illegal profit of VND 5.76 million, bringing the total amount payable to VND 405.76 million.
In addition, enterprises are required to complete land lease records according to the provisions of law.
The People's Committee of Luc Yen commune requested Hung Dai Son Company to strictly comply with the penalty decision. If the deadline is exceeded but not voluntarily implemented, the competent authority will carry out enforcement according to regulations.
