How are professional education teachers entitled to annual leave

Article 9 of Circular No. 05/2026/TT-BGDĐT stipulates the working regime for professional education teachers (effective from February 12, 2026) stipulates the annual leave period as follows:

1. The annual leave time of teachers includes: summer vacation, holiday, Tet and other holidays.

2. The annual summer vacation of teachers is implemented according to the Government's regulations.

3. Holidays, Tet and other holidays are implemented according to the provisions of labor law and social insurance.

4. In case the summer vacation time coincides with the maternity leave time of the female teacher, in addition to the leave time as prescribed in Clause 3 of this Article, the teacher's leave time includes:

a) Full maternity leave time as prescribed;

b) Summer vacation time does not coincide with the maternity leave time arranged before or after the maternity leave time, in accordance with the training plan of the vocational education institution;

c) In case the summer vacation period specified in point b of this clause is less than the number of annual leave days according to the provisions of labor law, teachers are entitled to additional leave, ensuring that the total number of additional leave days and the number of leave days specified in point b of this clause are equal to the number of annual leave days according to regulations. The additional leave time is arranged flexibly according to the agreement between teachers and vocational education institutions.

5. In case a male teacher is entitled to maternity leave when his wife gives birth according to the provisions of the law on social insurance, the teacher is considered to have completed sufficient standard hours during the leave period and does not have to perform post-mortem teaching. In case the maternity leave period when the male teacher's wife gives birth coincides with the summer vacation period, post-mortem leave is not allowed for the duplication period.

Thus, the annual leave period of vocational education teachers is implemented according to the above regulations.
