At the discussion on the draft Law on Construction (amended) on the morning of November 14, Minister Tran Hong Minh said that during the implementation of planning steps, project appraisal, and technical design, management agencies have fully controlled the requirements on scale, investment objectives, structure, and fire safety; however, before implementation, people and businesses still have to ask for a license, which is unreasonable.
It is a pity that this unreasonableness has existed for so many years, causing difficulties for people and businesses, wasting time and money for the whole society.
The regulations are for management, the effectiveness of management is smoothness. However, previous regulations caused congestion and problems due to the emergence of complicated and overlapping procedures, wasting people's strength and being useless.
In reality, up to now, although the regulations on construction licensing have involved many complicated procedures, violations have occurred, and many illegal construction works have sprung up blatantly.
So, what should be done with those regulations when they do not bring efficiency in construction management activities.
The draft Law has amended and supplemented the regulation of only granting licenses for works outside the planning scope or with a scale of more than 7 floors, which is an important reform step that people and businesses have long been waiting for.
Another unreasonable thing pointed out by Minister Nguyen Hong Minh: "The capacity of enterprises has been affirmed when participating in bidding and appointing bids, including conditions on capacity, machinery and vehicles, staff qualifications, financial capacity... Therefore, it is not necessary to stipulate the certificate of enterprise capacity".
Abolishing the corporate capacity certificate is about abandoning a procedure, reducing the number of requests, limiting harassment and negativity.
Each procedure that is abolished is to reduce the burden on businesses, from the cost of ensuring procedures to the cost of not being able to name.
Not to mention, complicated and cumbersome procedures, prolonging time, slowing down construction progress, leading to capital increase, causing damage to businesses.
The opinions of National Assembly deputies raised in the above discussion focused on one content, which is to expand the scope of canceling construction permits and cumbersome procedures but still ensure effective construction management.
To effectively manage construction, it is necessary to first of all make more public the regulations and construction standards, the red line boundary, density, height, and recess... so that people know.
When made public, any violations will be handled strictly.
In addition, we must uphold the responsibility of the leaders, not cause difficulties for the people, but also not let violations happen.
