Child sick, parents taking leave together are still entitled to social insurance benefits

When a child under 7 years old is sick, if both parents participate in compulsory social insurance, each person has the right to quit their job to take care of the child and enjoy benefits according to regulations.

According to the 2024 Law on Social Insurance, employees participating in compulsory social insurance are entitled to sickness benefits when they have to take leave to take care of sick children under 7 years old.

Notably, in cases where both parents participate in compulsory social insurance, the time each person enjoys benefits when taking care of sick children is calculated independently.

In particular, the great plus point of the social insurance policy is that it does not require families to choose only fathers or mothers to be entitled to allowances. Both husbands and wives can take leave to take care of sick children and are paid by the social insurance agency if they meet the conditions according to regulations.

The time to enjoy the sick child care regime for one year, from January 1 to December 31, is regulated according to each child's age. For children under 3 years old, each person is entitled to a maximum of 20 working days for each child. For children from 3 years old to under 7 years old, the maximum rest time is 15 working days for each child.

This time does not include holidays, Tet, weekly holidays.

The monthly sickness benefit level is equal to 75% of the salary used as the basis for social insurance contributions of the most recent month before the employee quits. In case of daily leave, the benefit level for one day is calculated by dividing the monthly allowance by 24 days.

To be granted benefits, when taking their children for examination and treatment, parents need to keep valid documents such as discharge papers for inpatient treatment or certificates of leave to enjoy social insurance benefits for outpatient treatment.

Employees submit dossiers to the enterprise no later than 45 days from the date of returning to work to be eligible for benefits.
