Voters in Da Nang City proposed that the Government strengthen inspection, examination, and supervision of health insurance contributions at enterprises, ensuring that employees pay correctly, fully, and on time to fully enjoy medical examination and treatment benefits. At the same time, study support mechanisms for cases where enterprises are late in paying and owe health insurance for a long time, helping employees continue to enjoy benefits, avoiding affecting health and life due to errors from enterprises.
The Ministry of Health said it will coordinate with functional agencies to strengthen inspection and handle businesses that are late in paying and evading health insurance, and at the same time ensure the rights of workers to medical examination and treatment.
Businesses must pay health insurance on time
According to the Ministry of Health, the law stipulates that employers are responsible for paying health insurance fully and on time for employees. For the monthly payment method, the payment deadline is the last day of the following month.
Acts such as not paying or paying insufficient health insurance money, not compiling a complete list of participants, declaring salaries as a basis for paying lower than regulations, or continuing to not pay after being urged by competent authorities can all be identified as late payment or evasion of health insurance.
Violating businesses must pay the remaining amount and pay an additional amount equivalent to 0.03% per day calculated on the amount and time of late payment or evasion. In addition, businesses may be administratively sanctioned; cases of evasion may be prosecuted for criminal liability according to regulations.
The Ministry of Health said it will coordinate with the Ministry of Finance, social insurance agencies and competent authorities to strengthen sharing and comparison of data on labor, wages and health insurance contributions.
Businesses that are late in payment for a long time, pay less than the number of people or pay salaries not at the correct level will be reviewed for urging, retroactive collection, inspection, examination and handling of violations.
Employees are refunded medical examination and treatment costs
In cases where businesses delay or evade health insurance contributions, causing employees not to have health insurance cards, employees are still protected by law.
According to the Ministry of Health, businesses that are late or evade payment must refund all medical examination and treatment costs within the scope of benefits and health insurance benefits that employees have had to pay themselves during the time they did not have cards due to the fault of the business.
Employees, relatives or legal representatives can submit dossiers requesting reimbursement of expenses to businesses that are late or evade health insurance payments.
According to Decree 188/2025/ND-CP, after receiving sufficient valid dossiers, enterprises are responsible for paying medical examination and treatment costs for employees within 40 days.
Enterprises that are late or evade paying health insurance do not lose the legitimate rights of employees. Enterprises not only have to remedy the remaining insurance amount but also have the responsibility to reimburse medical examination and treatment costs that employees have had to pay themselves due to violations.
