Hung Yen Department of Health has just issued decisions to sanction administrative violations against Mr. Do Van Hai and Mr. Vu Van Thao (both residing in Nam Thuy Anh commune, Hung Yen province) for providing medical examination and treatment services without a medical examination and treatment operating license.
According to the sanctioning decision, Mr. Do Van Hai, a doctor, was determined to have committed the act of providing medical examination and treatment services without a medical examination and treatment operating license. This act is regulated in point a, clause 6, Article 39 of Decree No. 90/2026/ND-CP dated March 30, 2026 of the Government regulating administrative sanctions in the field of health.
For the above violation, Mr. Do Van Hai was fined 45 million VND. He was applied an additional penalty form of suspension of operations from July 13, 2026. The decision clearly states that there are no aggravating or mitigating circumstances and no remedial measures are applied.
The second case is Mr. Vu Van Thao, medical assistant, who was fined for the same act of providing medical examination and treatment services without a medical examination and treatment operating license. The act was also determined to violate point a, clause 6, Article 39 of Decree No. 90/2026/ND-CP.
Mr. Vu Van Thao was fined 45 million VND, and also suspended from operation from July 13, 2026. The decision also determined that there were no aggravating or mitigating circumstances and no remedial measures were applied.
Both decisions require violators to pay a fine within 10 days from the date of receiving the decision. The decisions are sent to the Department of Medical and Pharmaceutical Practice Management under the Department of Health for monitoring and supervision and the People's Committee of Nam Thuy Anh commune for information and coordination in implementation.
Thus, the two individuals were both fined a total of 90 million VND and both were suspended from operation from July 13, 2026 for providing medical examination and treatment services without an operating license.
